Forward Landfill 2 15 August 2023 <br /> GeoTracker No : L10008827999 <br /> Violation (s ) Description/Location Law/Code/Order <br /> 3 Failure to restore beneficial uses of aquifer in the R5-2017- 0703 <br /> timeframe required by the CAO : 1 July 2023 . <br /> Requirement Implement corrective actions , submit a revised and Item 5 (c) ( iii) <br /> complete technical report , and restore beneficial uses of <br /> aquifer. <br /> I . Background <br /> Forward Inc. , a subsidiary of Republic Services ( Discharger) , which owns and operates the <br /> Forward Landfill in San Joaquin County ( Landfill) . Waste disposal operations , Landfill closure , <br /> implementation of corrective actions and groundwater remediation at the Landfill are regulated <br /> by Waste Discharge Requirements Orders R5-2003-0080 and R5-2014-0006 (collectively , <br /> WDRs) and Cleanup and Abatement Order R5-2017-0703 ( CAO) . <br /> Because the Landfill failed to comply with a previously issued cleanup and abatement order , <br /> R5-2008-0714 , the uncontested 2017 CAO was issued to formally require an additional <br /> investigation to fully delineate the vertical and lateral extent of the plume and the installation of <br /> enhanced corrective action measures such that no VOCs will be present in the groundwater <br /> beyond the Landfill boundaries . <br /> ll . Legal Requirements <br /> In addition to the requirements of the CAO , each landfill falls under Federal as well as State <br /> landfill regulations , which clearly define the expectations for Corrective Action Programs at <br /> these sites . The California Code of Regulations , Title 27 , Section 20430 , outlines the <br /> requirements of a Corrective Action Program , in part , as follows : <br /> (a) General--A discharger required pursuant to § 20385 to establish a corrective action <br /> program for a Unit shall, at a minimum, comply with the requirements of this section <br /> for that Unit. <br /> (b) Standards-- The discharger shall take corrective action to achieve the following goals: <br /> to remediate releases from the Unit; to ensure that the discharger achieves <br /> compliance with the Water Standard adopted under § 20390 ' for that Unit. The <br /> RWQCB shall specify the Water Standard for corrective action [including any <br /> concentration limits greater than background, under § 20400(c-g)] in the WDRs. <br /> (c) Scope of Actions-- The discharger shall implement corrective action measures that <br /> ensure that COCs achieve their respective concentration limits at all Monitoring <br /> Points and throughout the zone affected by the release, including any portions <br /> thereof that extend beyond the facility boundary, by removing the waste constituents <br /> or treating them in place . The discharger shall take other action approved by the <br /> RWQCB to prevent noncompliance with those limits due to a continued or <br /> subsequent release from the Unit, including but not limited to, source control. <br /> ' CCR Title 27 Section 20390 — Water Quality Protection Standard : Components & Duration - For each Unit, the <br /> RWQCB shall establish a water quality protection standard (Water Standard) in the WDRs . This Water Standard shall <br /> consist of the list of constituents of concern ( under § 20395) , the concentration limits ( under § 20400) , and the Point <br /> of Compliance and all Monitoring Points ( under § 20405) . This Water Standard shall apply during the active life of the <br /> Unit, the closure period , the post-closure maintenance period , and during any compliance period (under § 20410) . <br />
