Permits <br />The Foothill Sanitary Landfill operates under the following permits and conditions (Appendix A): <br /> <br />Solid Waste Facilities Permit (SWFP) No. 39-AA-0004, issued by the California Department of <br />Resources Recycling and Recovery (CalRecycle). <br />Waste Discharge Order No. R5-2003-0020, issued by the California Regional Water Quality <br />Control Board (RWQCB), Central Valley Region in 2003 <br />Permit to Operate N-4070, issued by the San Joaquin Valley Air Pollution Control District <br />Land Use Permit UP#3295 <br />Land User Permit UP#3541 <br />Storm Water Permit WIDID # 5S39I005576 <br /> <br />2.5.3. CEQA Information <br />Section 15261 of Title 14 CCR states that public agency projects approved before November <br />23, 1970, and private projects approved before April 5, 1973, are exempt from the California <br />Environmental Quality Act (CEQA) until such time that changes to the project are proposed <br />which might have a significant effect on the environment. Because operations at the Foothill <br />Landfill began in 1966 as a private enterprise, seven years before the requirement for formal <br />CEQA compliance became effective. The landfill was exempt from formal CEQA <br />documentation. <br /> <br />Two CEQA documents were prepared to address a proposed permit revision in 1995 when the <br />County sought to increase the peak daily refuse disposal limit from 720 to 1500 tons per day. <br />These documents included Negative Declaration (95-OIND-75100, March 29, 1995), and a <br />Notice of Determination (April 28, 1995) (Appendix A). <br /> <br />No changes that might have a significant impact to the environment are proposed at this time. <br />The County is contemplating proposing a permit revision that would allow the increase in permit <br />height. If so proposed, the County will perform an Initial Study, and proceed with other CEQA <br />documentation as indicated by the Initial Study. <br />
