Foothill Landfill <br />Storm Water Pollution Prevention Plan <br /> <br /> <br /> <br />Page 78 <br />13.2 Off-Site Compliance Option <br />13.2.1 Off-Site Compliance Option Requirements <br />A facility may enter into a local agreement with the local jurisdiction or jurisdictions to <br />participate in the development, implementation, and operation of an off-site storm water <br />capture and/or infiltration BMP or BMPs (off-site BMP or BMPs) provided the following <br />criteria are met: <br />1. The off-site BMP must maintain the effective capacity to capture, capture and divert, <br />infiltrate and/or evapotranspire the volume of runoff produced up to and during the <br />85th percentile 24-hour rain event based upon precipitation data from the National <br />Oceanic and Atmospheric Administration and/or local, historical precipitation data and <br />records; and <br />2. The authorized non-storm water and industrial storm water must not discharge to a <br />water of the United States or a water of the state prior to reaching the off-site BMP or <br />BMPs. <br />3. A facility shall work with the local jurisdiction or jurisdictions to define participation <br />in the development, implementation, and operation of the off-site BMP or BMPs. <br />4. A facility and local jurisdiction shall ensure the agreement includes applicable <br />protections for waters of the state for infiltration BMPs to demonstrate meeting the <br />criteria in General Permit Attachment I, Section IV. <br />5. The applicable RWQCB Executive Officer and local jurisdiction or jurisdictions <br />representatives shall approve the Facility’s participation in the off-site compliance <br />option. The applicable RWQCB shall provide at least a thirty (30) day public notice to <br />obtain written comments prior to the approval of the off-site compliance option. <br />6. A facility may enter into a local agreement with another facility or facilities to <br />participate in the development, implementation, and operation of an off-site BMP <br />provided the criteria in General Permit Attachment I, Section III.A.1-2 are met. The <br />agreement between facilities shall 1) include equal responsibility of the off-site BMP <br />or BMPs among all parties involved, 2) not involve discharges to a municipal separate <br />storm sewer system (MS4), and 3) be approved by the applicable RWQCB Executive <br />Officer. <br />13.2.2 General Permit Exemptions for installed Off-Site Compliance Option <br />A facility participating in an approved local agreement and discharging into an off-site BMP <br />or BMPs and in compliance with the off-site compliance option requirements in General Permit <br />Attachment I are exempt from the following provisions and requirements of the General <br />Permit: <br />1. Section VIII.A Discharges to Ocean Waters. <br />2. Section IX Training Qualifications, the requirement to obtain a QISP. <br />3. Section X.A.7, X.H.2. Implementation of Advanced BMPs. <br />4. Section X.H.6 Design Storm Standards for Treatment Control BMPs.
