Section XII Exceedance Response Actions. <br />13.1.6 RWQCB Authorities for On-Site Compliance Option <br />1. The applicable RWQCB Executive Officer has the authority to review site-specific <br />information and disapprove any on-site infiltration BMP or BMPs as a permissible <br />compliance option for a facility to address groundwater concerns under their <br />RWQCB’s jurisdictions. <br />2. The RWQCB Executive Officer may require a facility to modify the facility’s SWPPP <br />to demonstrate compliance with the on-site compliance option or address other regional <br />groundwater concerns. Upon written request of the RWQCB Executive Officer, a <br />facility must submit the required SWPPP modifications by the required due date, or no <br />later than 90 days, whichever is shortest. <br />3. The RWQCB may require additional information or modifications to the facility’s <br />SWPPP and/or BMP or BMPs to address: <br />A. Exceedances of applicable water quality objectives. <br />B. Impacts to groundwater beneficial uses; or, <br />C. Impacts to the groundwater quality due to the infiltration of the industrial <br />authorized NSWDs and/or storm water discharges at the facility. <br />4. The SWQCB Executive Director or the applicable RWQCB Executive Officer may <br />authorize the discontinuation of monitoring for the infiltrated water if no threat to <br />groundwater is determined <br />
