Foothill Landfill
Storm Water Pollution Prevention Plan

Page 80
4. Summary of actions (including, but not limited to, monitoring, structural BMPs, non-
structural BMPs, training) the facility planned for implementation over the next two
years to comply with the agreement with the local jurisdiction.
5. The status and schedule of the local agreement project or projects completed this
monitoring and reporting year.
6. The status and schedule of the local agreement project or projects planned for
implementation over the next two years; and,
7. A status and schedule implementation update regarding the facility’s required actions
per the local agreement.
13.3 Protection of Waters of the State
13.3.1 Prohibited Discharges for Installed Compliance Options:
1. Water related to the cleaning and maintenance of the BMP is an unauthorized NSWD;
and,
2. Storm water associated with industrial activities occurring below the 85th percentile
24-hour storm event and/or sources of non-storm water authorized by this General
Permit in Section IV.
13.3.2 Migration of Pollutants into Groundwater
The migration of pollutants that cause or contribute to the exceedance of a water quality
objective in groundwater is prohibited. A facility shall ensure infiltration BMP or BMPs
implemented for compliance with a compliance option shall be designed and operated to:
1. Prevent captured and/or infiltrated storm water from causing or contributing to the
exceedance of a water quality objective in groundwater.
2. Prevent the constituents in Attachment I, Table B from causing a threat to the
attainment of the groundwater’s beneficial use(s) if identified and have the potential to
discharge to groundwater.
3. Prevent the migration of existing soil contamination to groundwater and not interfere
with any active remedial activities for existing groundwater contamination in the
vicinity of the facility and/or off-site BMP or BMPs.
4. Address other similar factors which may degrade groundwater; and
5. For the on-site compliance option, include a determination of General Permit
Attachment I, Section IV.B.1-4 in the certification required by the California licensed
civil engineer in General Permit Attachment I, Section II.C.
13.3.3 Infiltration and Groundwater Protection
The infiltration of industrial storm water and authorized non-storm water must meet the
following requirements:
1. Infiltration BMPs must not cause or contribute to an exceedance of an applicable
groundwater quality objective.
