Maintenance Manager Luu stated they wound up there because custodial staff are unaware of what can and cannot be disposed of in the trash. -Facility staff was unaware of the labeling requirements for universal waste. REGULATION GUIDANCE: The business owner must ensure that all employees are thoroughly familiar with proper waste handling and emergency procedures, relevant to their responsibilities during normal facility operations and emergencies. CORRECTIVE ACTION: Immediately train the employees. Provide proof of training within 30 days to the San Joaquin County Environmental Health Department(EHD)for employees whose responsibilities include hazardous waste. This is a (Class 2)Violation. 5 CA Code of Regulations 66262.42(a)(c)(d) 3010030 - Completed all Uniform Hazardous Waste Manifest exception reporting requirements OBSERVATION: The facility did not have exception reports on site for Uniform Hazardous Waste Manifest(UHWM): -024637234JJK REGULATION GUIDANCE: (a)A generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the designated facility within 35 days of the date the waste was accepted by the initial transporter shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the hazardous waste. (c)A hazardous waste generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste is submitted, within 60 days from the date that the hazardous waste was accepted by the initial transporter, shall submit to the department a legible copy of the manifest, with some indication that the generator has not received confirmation of delivery. (d) Generators shall submit the information to the department at: DTSC Report Repository, Generator Information Services Section, P.O. Box 806, Sacramento, CA 95812-0806 CORRECTIVE ACTION: Locate a copy of all destination facility signed manifests. If the destination facility signed manifests cannot be found, send to DTSC a copy of each generator signed manifest and a statement that the designated facility signed copy was not received by the generator.
