CP26 - UST FULL Inspection Report Facility Name: Facility Address: Date: SHELL FOOD MART 12320 N EL DORADO ST, STOCKTON February 24, 2026 5 23 CCR 16 2613(a)(6) and (b), 2650(a), (d), and (e) 2011013 - Facility has submitted a complete and accurate UST Response Plan OBSERVATION: Owner/Operator failed to submit a complete and accurate UST Response Plan. The UST Facility Response Plan submitted to CERS is outdated. During the inspection, Manager Kelli Flesher stated that the facility has changed owners, effective 10/1/25. CERS has not been updated and incorrectly lists outdated information for the owner/operator. REGULATION GUIDANCE: Owners/operators must submit a response plan to the Unified Program Agency which demonstrates that any unauthorized release will be removed from the secondary containment as soon as practical. The response plan must include, but is not limited to, the following: (1)A description of the proposed methods and equipment to be used for removing and properly disposing of any hazardous substances, (2) For methods of monitoring where the presence of the hazardous substance in the interstitial space cannot be determined directly, the response plan must specify the proposed method(s)for determining the presence or absence of the hazardous substance, (3)The name(s), title(s) and emergency contact information of the person(s) responsible for authorizing any work necessary under the response plan or, if applicable, identify that there is a continuously staffed emergency operations center authorized to coordinate such a response and provide a 24-hour phone number for that center. CORRECTIVE ACTION: Submit a complete and accurate UST Response Plan that meets all requirements. This is a (Class 2)Violation. 6 23 CCR 16 2613(a)(7), 2690(a)(5); HSC 6.7 25292.2 2011008 - Submitted/maintained current Cert of Financial Responsibility/mech of financial assurance (TCR 11) OBSERVATION: Owner/Operator failed to submit and/or maintain a complete and current Certification of Financial Responsibility or other mechanism of financial assurance. During the inspection, Manager Kelli Flesher stated that the facility has changed owners, effective 10/1/25. The Certificate of Financial Responsibility document and Letter from the CFO have not been updated with the new owner information. REGULATION GUIDANCE : The owner or operator must submit a current Certification of Financial Responsibility and maintain all applicable supporting mechanisms available for review by the Unified Program Agency or the Board upon request, or as otherwise required by the federal act. CORRECTIVE ACTION: Submit a complete and current Certification of Financial Responsibility, or other mechanism of financial assurance within 30 days. This is a (Minor)Violation. 8 23 CCR 16 2613(a)(9) and (b), 2630(a) 2011007 - Underground Storage Tank Statement of Understanding and Compliance Form submitted (TCR 10) OBSERVATION: The Underground Storage Tank Statement of Understanding and Compliance Form found in CERS is outdated. During the inspection, Manager Kelli Flesher stated that the facility has changed owners, effective 10/1/25. The new owner has not submitted a new Underground Storage Tank Statement of Understanding and Compliance Form REGULATION GUIDANCE: This form must be uploaded to the California Environmental Reporting System (CERS). CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov and upload the Underground Storage Tank Statement of Understanding and Compliance Form for this facility.
