The most recent financial responsibility documents in CERS are dated 4/1/2024. - Section A of the Certification of Financial Responsibility is not complete. REGULATION GUIDANCE: (5) Financial Responsibility Mechanisms— Identification of mechanisms used to demonstrate compliance with financial responsibility requirements for petroleum underground storage tanks as specified in sections 25292.2 and 25299.31 of the Health and Safety Code, the federal act, and regulations adopted pursuant to the federal act, or specify that the facility is exempt from the requirements. If required to demonstrate financial responsibility, the owner or operator must submit a current Certification of Financial Responsibility and maintain all applicable supporting mechanisms available for review by the Unified Program Agency or the Board upon request, or as otherwise required by the federal act. CORRECTIVE ACTION: Submit a complete and current Certification of Financial Responsibility, or other mechanism of financial assurance within 30 days. This is a Repeat(Class 2)Violation. 7 23 CCR 16 2613(a)(8) and (b), 2630(b) 2011004 - Owner/Operator submitted DO form within 30 days of UST install or DO change (TCR 10) OBSERVATION: Owner/Operator did not submit the Designated Underground Storage Tank Operator Identification Form to the UPA. REGULATION GUIDANCE: (b)Within 30 days of installing an underground storage tank system or any change to the designated underground storage tank operator(s), the owner or operator must submit to the Unified Program Agency information identifying the designated underground storage tank operator(s)for the facility. The name of each designated underground storage tank operator listed in the California Environmental Reporting System must be identical to that individual's name as listed on the individual's International Code Council UST System Operator certificate. CORRECTIVE ACTION: Submit Designated Underground Storage Tank Operator Identification Form to the UPA within 30 days of installing UST or changing DO. This is a Repeat(Class 2)Violation. 8 23 CCR 16 2613(a)(9) and (b), 2630(a) 2011007 - Underground Storage Tank Statement of Understanding and Compliance Form submitted (TCR 10) OBSERVATION: Owner/operator failed to submit the Underground Storage Tank Statement of Understanding and Compliance Form to CERS. REGULATION GUIDANCE: (a)Within 30 days of installing an underground storage tank system, or any change to the owner or operator, the owner or operator must submit to the Unified Program Agency a signed "Underground Storage Tank Statement of Understanding and Compliance Form," located in appendix 1, for the facility, indicating that the owner or operator understands and complies with all applicable underground storage tank requirements. CORRECTIVE ACTION: Submit the Underground Storage Tank Statement of Understanding and Compliance Form. This is a Repeat(Class 2)Violation.
