SAN JOAQUIN Environmental Health Department <br /> COUNTY— <br /> Hazardous Materials Business Plan Program Inspection Report <br /> Facility Name: Facility Address: Date: <br /> PEARL CROP INC 11550 INDUSTRIAL DR, STOCKTON October 02, 2025 <br /> 13 CA Health and Safety Code 25505(a)(4) 1020001 - Established and electronically submitted adequate training program <br /> OBSERVATION: A training program was lacking or insufficient. <br /> -The facility has not trained employees on all information in the emergency response/contingency plan required to be <br /> submitted to CERS. <br /> -The on-site facility training plan that covers chemical safety, including handing and storage of fumigation chemicals, has <br /> not been implemented. During the inspection, a container of Magnesium Phosphide with the words "Dangerous When <br /> Wet"was observed with the lid unsecured in the rain in the outdoor chemical storage area adjacent to the fumigation <br /> room. The sides of the storage area were open to rain, the ground inside the area was wet and water from the rain was <br /> observed pooled on the container's lid. Safety employee Ervin lifted the lid of the container and stated that product <br /> remained inside. <br /> REGULATION GUIDANCE: Training programs for all employees and annual training, including refresher courses, shall <br /> include familiarity with the facility's Emergency response plans and procedures in the event of a release or threatened <br /> release of a hazardous material. Training shall cover, but not limited to, all of the following: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program <br /> agency. <br /> (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice, for the business site. <br /> These training programs may take into consideration the position of each employee. <br /> CORRECTIVE ACTION: Immediately prepare or update the facility's training program, log into the California <br /> Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and <br /> submit to the EHD for approval. <br /> This is a Repeat(Class 2)Violation. <br /> 14 CA Health and Safety Code 25505(a)(4) 1020002 - Provided initial and annual training and maintained training records <br /> for a minimum of three years <br /> OBSERVATION: The facility could not provide HMBP training records for the past three years. EH&S Manager Jackie <br /> Serra was able to provide partial training records for some but not all employees for 2024 and 2025. The facility could not <br /> provide any training records for 2023. <br /> REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive <br /> initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or <br /> threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and <br /> procedures: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program <br /> agency. <br /> (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice, for the business site. <br /> This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br /> years. <br /> CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br /> training records to the EHD. <br /> This is a Repeat(Class 2)Violation. <br /> EHD-CUPA Inspection Report IS02 Page 5 of 6 FA0007213 PR0520255 4559018 10/15/2025 <br /> 1868 E.
