The business plan was submitted late on 5/28/2025 for <br />the year of 2025. The business started operations 2/1/2025. The business did not make the submittal with in 30 days of <br />starting operations. This violation has been corrected. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year <br />and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the <br />annual HMBP to CERS by January 15. <br />This is a (Class 2) Violation. <br />5 <br />CA Health and Safety Code 25508.1(a) -(f) 1010006 - Updated within 30 days of 100% increase or new haz; change of <br />address/owner/name; or change in ops <br />OBSERVATION: During the inspection, Mike Fuhrman stated that business has been operating since 2/1/2025. The <br />business has not updated and submitted the information within 30 days. The business has updated the business plan in <br />CERS on 5/28/2025. This violation has been corrected. <br />REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br />information submitted to the California Environmental Reporting System (CERS): a) A 100 percent or more increase <br />in the quantity of a previously disclosed material. b) Any handling of a previously undisclosed hazardous materials <br />c) A change of business or facility address d) Change business ownership e) Change of business name f) <br />(1) A substantial change in the handler's operations occurs that requires modification to any portion of the business plan. <br />(2) For the purpose of this subdivision, "substantial change" means any change in a facility that would inhibit <br />immediate response during an emergency by either site personnel or emergency response personnel, or that could <br />inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, or <br />impede implementation of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is a (Class 2) Violation. <br />EHD - CUPA Inspection Report IS01 <br />Page 2 of 3 FA0009960 PRO521651 4514106 6/1/2025 <br />1868 E.
