Port recorded pre-decisional land use covenants (LUCs)to restrict use of the properties, which total approximately 560 acres,pending remediation. Site 47 is part of the 2003 property transfer, and the associated LUC is referred to in this Site 47 RAP as the Pre-Decisional LUC. DTSC and the CVRWQCB, collectively referred to hereinafter as the "State," are the lead regulatory agencies for oversight of the Port's remediation at Site 47. DTSC would be approving this Site 47 RAP and selecting the remedy pursuant to Resource Conservation and Recovery Act Sections 3006 and 6001 (United States Code Sections 6926 and 6961) and California Health and Safety Code (HSC), Division 20, Chapters 6.5 and 6.8. The CVRWQCB would be approving the RAP and selecting the remedy pursuant to the California Water Code, Division 7; California HSC, Division 20, Chapters 6.67, 6.7, and 6.75; and the California Code of Regulations (CCR), Title 23, Chapter 16. As specified in the 2003 Consent Agreement, the remedy for Site 47 will be conducted in a manner consistent with the following laws and regulations: • National Oil and Hazardous Substances Pollution Contingency Plan (NCP), 40 Code of Federal Regulations Part 300, as amended; • California HSC Section 25100 et seq., as amended; • California Water Code, Division 7, Section 13000 et seq.; • California HSC, Division 20, Chapters 6.67, 6.7, and 6.75; and • California CCR, Title 23, Chapter 16. This Site 47 RAP was prepared in accordance with the 2003 Consent Agreement, California HSC Section 25356.1, and DTSC Remedial Action Plan(RAP) guidance. 1.3 Site Description RRI is approximately 1,459 acres and is located within the Sacramento-San Joaquin River Delta (Delta) at the confluence of the San Joaquin, Sacramento, Mokelumne, Calaveras, and Cosumnes Rivers (Figure 1). RRI is bounded by the Burns Cutoff to the south and west, the Stockton Deep Water Channel to the north, and the San Joaquin River to the east. RRI is protected from the higher elevation water in the rivers and channels by levees that surround the perimeter of RRI. Site 47 is one of 52 remedial sites transferred to the Port by the Navy(Figure 2). The Site 47 boundary was identified in the Pre-Decisional LUC and encompasses former Navy Environmental Baseline Survey Parcels 138 through 142 (Figure 3). Site 47 is bounded by McCloy Avenue on the north,North Hooper Street on the east, and a drainage channel to the south. The western boundary of the site is partially curving and is positioned between a curved section of the Port of Stockton Expressway and Daggett Road. The southern boundary of Site 47 is a drainage channel, which connects to the island-wide drainage network and pump station. Site 47 contains a former model airplane landing strip and skeet/trap shooting range, abandoned buildings and sports courts, and a section of railroad tracks. Most of Site 47 is unpaved.
