9. CALIFORNIA ENVIRONMENTAL QUALITY ACT <br /> The 2003 Consent Agreement indicates the State will comply with the CEQA for all activities <br /> that are"projects" as defined by CEQA. The 2003 Consent Agreement also indicates the Port <br /> will prepare any necessary CEQA documents. On January 11, 2022, the Port released the draft <br /> CEQA documentation that described and analyzed the proposed remedial alternative and the <br /> planned Project Sierra development. The Port's CEQA document is the TC NO. CAL. <br /> Development Warehousing and Distribution Facility Project Environmental Impact Report <br /> (EIR). <br /> The Port is preparing the final EIR, which will include responses to comments received on the <br /> draft EIR. No changes to the proposed remedial alternative were required based on comments <br /> received on the draft EIR. <br /> Provided the alternative selected following public review of the draft RAP is not substantially <br /> different from that presented in the draft RAP, DTSC will rely on the EIR to comply with <br /> CEQA.
