DocuSign Envelope ID:08557A62-FBC8-4D46-BFAC-02E04At D8395 <br /> AMENDED ENVIRONMENTAL ACCESS AGREEMENT <br /> FOR ADDITIONAL SOIL SAMPLING <br /> This Amended Environmental Access Agreement for Additional Soil Sampling <br /> 4/27/2020 <br /> ("Amended Agreement") is entered into this day of 2020 ("Effective <br /> i <br /> Date"), between Colberg Boat Works, LLC, ("Permittor") and Diamond International <br /> Corporation("Diamond") and PES Environmental, Inc. ("PES") (collectively referred to as <br /> "Permittees"). The Permitter and the Permittees are collectively referred to as "Parties." <br /> RECITALS <br /> A. Permittor is the owner of that certain real property located at 848 West Fremont <br /> Street, Stockton, California. <br /> B. Diamond historically leased and operated on the northern two acres of the <br /> property at 848 West Fremont Street. The two-acre area is identified as the"Project Site" on <br /> Plate 1 of the Final Revised Site Characterization and Removal Action Workplan,Northern 2- <br /> Acre Portion of Colberg Boat Works dated August 11, 2019 ("RAW") and is referred to in this <br /> Agreement as the "Property." PES is Diamond's contractor that will access the Property and <br /> conduct work on behalf of Diamond. <br /> C. In 2012,the Parties entered into an Environmental Access Agreement dated June <br /> 12, 2012 for the implementation of an Investigation Work Plan at the Property. <br /> D. In 2019,the Parties entered into an Environmental Access Agreement for <br /> Additional Soil Sampling dated September 30,2019 under which PES conducted additional <br /> sampling at the Property in accordance with requirements by the California Department of Toxic <br /> Substances Control ("DTSC")set forth in Appendix A of the RAW. <br /> I <br /> Page 1 of 2 <br /> LEGAL02/39534804v2 <br />
