REc��V <br />AUG l E� <br />aFFic�'o/V ,/OA � o 005 <br />Sierra Chemical has four individuals trained to the hazardous materials MERGE �N7y <br />technician level to respond to spills or gas releases. This team is not qualified NcySER�icRs <br />to respond to any chemical emergency at this location for the following <br />reasons. <br />A. There is only three eact} self-contained breathing apparatus (SCBA) <br />on site. A minimum of I(four SCBA is required to properly respond. <br />B. There is only two each level "A" suites on site. A minimum of four <br />SCBA is required to prpperly respond. <br />C. The level "A" suits have never been tested as required by 29 CFR <br />1910.120 (q). <br />D. 29 CFR 1910.120(q) requires at a minimum, two individuals as entry <br />and two individuals as back up for rescue. <br />At the time of the closing conference we informed you that we agreed with your <br />assessment and had made a policy decision to no longer provide emergency <br />response. A copy of our Interim Procedure on Emergency Response For The <br />Stockton Facility was provided. <br />12. Hazardous Materials Properly) Stored and Label <br />Numerous containers are not properly marked as to the contents. <br />During the closing conference you were informed that all of the referenced <br />materials had been packaged anc labeled. This issue was also discussed with the <br />employees during the tailgate meeting held July 29h. <br />13. Soil and Facility Appear Non -Contaminated <br />Sump located at the outside bottling area is full of hazardous waste caustic as <br />well as a pool next to the sump. <br />See the response to Item 10. <br />There is a large poly tank located by the outside bottling area with a paper <br />sign "DE Waste". The bottom of the tank there is a pipe coming out about a <br />foot. The pend of the pipe does not have a shut off valve. The pipe has what <br />looks like plastic shrink rap cohering the pipe and tied off with a cloth. <br />There is liquid under the pipe and you can tell that the liquid came from the <br />pipe. I pH the liquid and it was 13 to 14. <br />
