Failed to test spill prevention liquid sensing devices in the tanks annually and kept records. -- SPCC Plan Section 4.7 stated liquid sensing devices in tanks shall be tested annually. Conduct inspections and tests in accordance with written procedures that you or the certifying engineer develop for the facility. You must keep these written procedures and a record of the inspections and tests, signed by the appropriate supervisor or inspector, with the SPCC Plan for a period of three years. Records of inspections and tests kept under usual and customary business practices will suffice for purposes of this paragraph. Test the liquid sensing devices in the tanks in accordance to written procedures developed by you or the certifying engineer. Submit a copy of the signed report of the results and the written procedure by November 21 2010. Continue testing annually, and retain a copy of the appropriately signed report of the test with the SPCC Plan for minimum of three years available for inspection. 32. Failed to train personnel on spill prevention and conduct annual prevention briefings. -- At a minimum, train your oil-handling personnel in the operation and maintenance of equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and regulations; general facility operations, and, the contents of the facility SPCC Plan. Schedule and conduct discharge prevention briefings for your oil-handling personnel at least once a year to assure adequate understanding of the SPCC Plan for that facility. Such briefings must highlight and describe known discharges or failures, malfunctioning components, and any recently developed precautionary measures. " Conduct spill prevention training and submit evidence of the training to this office by November 21, 2C1C. Begin conducting annual briefing per this section. NOTES The inspection was conducted on October 14, 2010, but the final version of the inspection report was not completed until October 20, 2010. The EHD copy of the SPCC Plan is different than the final copy retained on site. Please submit the signed version of Page 3 and the completed Certification Checklist in Appendix A to this office. Complete and submit a copy of the Return to Compliance Certification form (provided with this report) with a statement of how each violation was corrected, including supporting documentation by November 21, 2010 ALL EHD STAFF TIME ASSOCIATED HATH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE(f122).
