The Spill Prevention, Control, and <br />Countermeasure (SPCC) Plan was amended in October 2011 to include the following changes: increased secondary <br />containment capacity for the diesel and gasoline tanks. These amendments are technical changes, requiring a PE <br />certification within six months of amendment. A technical amendment is a change to the facility, tanks, procedures, <br />materials, construction, design, or maintenance that materially increases or decreases the facility's potential for oil <br />discharge. Immediately obtain a complete PE certification for the facility's SPCC plan. Submit a copy of the <br />completed, certified SPCC plan to the EHD for review. <br />This is a Class II violation. <br />609 <br />CFR 112.7(a)(3vi), 112.7(a4) Plan failed to adequately contain procedures for reporting a discharge. <br />The Spill Prevention, Control, and Countermeasure (SPCC) Plan does not provide information and procedures to <br />enable a person to adequately report a discharge. The contact list did not include phone numbers for the Cal OES <br />reporting center, SJCEHD, and included outdated primary response coordinator information. If a response plan was <br />not submitted to the Regional Administrator, this information must be included in the SPCC Plan. The SPCC plan <br />must include a contact list and phone numbers for the facility response coordinator, National Response Center, <br />cleanup contractors, and all appropriate Federal, State, and local agencies. Immediately amend the SPCC Plan to <br />include this information and submit a copy of the revision to the EHD. <br />This is a minor violation. <br />613 <br />CFR 112.7(c) Failure to provide appropriate secondary containment, diversionary structures or equipment. <br />The motor oil tanks, waste diesel drum, oil water separator skim tank were observed onsite with no secondary <br />containment . A facility shall provide appropriate containment and/or diversionary structures or equipment to prevent <br />a discharge. The entire containment system, including walls and floor, must be capable of containing oil and must be <br />constructed so that any discharge from a primary containment system will not escape the containment system before <br />cleanup occurs. Immediately provide adequate secondary containment for all aboveground petroleum storage <br />containers larger than 55 gallons. <br />This is a Class II violation. <br />618 <br />CFR 112.7(e), 112.8(c)(6) Failed to conduct inspections or integrity tests or maintain records for 3 years. <br />Copies of recent inspection and testing records were not found on site. The most recent inspection forms were dated <br />March 2016. Inspections and tests must be conducted in accordance with the written procedures developed in the <br />Spill Prevention, Control, and Countermeasure (SPCC) Plan. Records of these inspections and tests must be signed <br />by the appropriate supervisor or inspector and kept on site with the SPCC Plan for a period of three years. <br />Immediately locate a copy of all inspection and testing records for the last three years, maintain them on site, and <br />submit copies to the EHD. <br />This is a repeat violation, Class ll. <br />Page 5 of 9 <br />
