this lease, Novembt— 30, 1993. If the initi.., option for the <br />Second Term is exercised, lessee shall have an additional option to <br />extend the lease for an additional five (5) years ("Third Term") <br />provided lessee gives notice of intention to do so at least ninety <br />(90) days prior to the end of the Second Term. The lessee shall <br />have the option of further extending the lease for an additional <br />five (5) years by providing notice of intention to do so at least <br />ninety (90) days prior to the end of the Third Term. All other <br />terms and conditions of this lease shall remain the same for each <br />extended term, except for the rental amounts for each term. <br />4. The lessee shall conduct a convenience store business and <br />petroleum products and vehicle supplies sales business on the <br />premises. No other convenience store shall be operated on the <br />premises, nor will the sale of products usually associated with <br />convenience stores be sold by others sharing common areas with <br />lessee. Lessee agrees not to use the property to compete with the <br />adjoining bait, tackle and sporting goods business or sell products <br />usually associated therewith. The bait and tackle business may <br />sell dry cell batteries, ice and sporting clothing and accessories. <br />5. Rent shall be FOUR THOUSAND DOLLARS ($4,000.00) per month <br />for the first year of the initial term of this lease. Rent for the <br />first year of the Second Term shall be FIVE THOUSAND DOLLARS $5F000 <br />per month. Rent for each succeeding year of the Second Term shall <br />be determined by reference to the Bay Area Consumer Price Index of <br />the United States Department of Labor, Bureau of Labor Statistics. <br />The rent shall be increase by the percentage change in the above <br />2 <br />
