1 I would be filing two Proposition 65 notifications, one on the
2 acid spill and one on the ditch.
3 12 . Mr. Hufstetler stated he would be the responsible
4 party for the notification, and he would notify the parent
5 company of the spills. He stated the parent company had an
6 environmental agent who would come out from the home office to
7 deal with the environmental issues.
8 13 . Upon returning to the office, I wrote out a notice of
9 violation and mailed it to Mr. Hufstetler. A copy of the notice
10 is attached hereto as Exhibit 1. The notice ordered Earthgrain
11 to cease and desist illegal discharge of hazardous waste and to
12 clean up the contaminated area immediately.
13 14 . I sent notice of the situation at the
14 Rainbow/Earthgrain facility to the City of Stockton, Municipal
15 Utilities Department and to the California Department of Fish
16 and Game.
17 15. On November 27, 1990, I returned to the
18 Rainbow/Earthgrain facility to meet with City of Stockton
19 officials Larry Williams and Rhonda Archbold and Fish and Game
20 Warden Dennis DeAnda. I want to the area where the contaminated
21 cistern and drainage ditch were. There was an electric pump in
22 the cistern and a 2 inch blue plastic hose going from the
23 cistern in a northwesterly direction. Photograph No. 1 attached
24 hereto shows an Earthgrain employee and Warden DeAnda standing
25 at the cistern. The parking lot in the photo is the
26 Rainbow/Earthgrain parking lot.
27 16. Photograph No. 2 attached hereto is a close up of
28 Warden DeAnda and the Earthgrain employee at the cistern on
4
