I <br /> I <br /> I <br /> 1 <br /> ;safety or the environment and recovering the cost thereof. <br /> 2 !Notwithstanding compliance with the terms of this Order, PG&E may be <br /> required to take further actions as are necessary to protect public <br /> 4 health, welfare, and the environment. PG&E has not waived and <br /> 5 iexpressly reserves its rights to judicial, review as provided in <br /> sHealth and Safety Code Section 25356. 1 (f) or otherwise, as well as <br /> 7 any statutory right to arbitration of liability as to costs, except <br /> 8 for those costs specified in Paragraph 3 . 29 . 1. <br /> 9 3 . 15 . Site Access. Access to the Site and laboratories used for <br /> 10 analyses of samples under this Order shall be provided at all <br /> i <br /> 11 reasonable times to employees, contractors and consultants of the <br /> 12 Department. Nothing in this paragraph is intended or shall be <br /> l3 �, construed to limit in any way the right of entry or inspection that <br /> 14 ! the Department or any other agency may otherwise have by operation <br /> 15ofany law. The Department and its authorized representatives shall <br /> 16 have the authority to enter and move freely about all property at <br /> 17theSite at all reasonable times for purposes of carrying out their <br /> 18 legal duties, including, but not limited to: inspecting records, <br /> 19 �loperating logs, sampling and analytic data, and contracts relating <br /> 201 <br /> to this Site; reviewing the progress of PG&E in carrying out the <br /> 21 terms of this Order; conducting such tests as the Department may <br /> 22 ! deem necessary; and verifying the data submitted to the Department <br /> 23 ' by PG&E. To the extent that work required pursuant to this Order <br /> 24 !! must be done on property not owned or controlled by PG&E, PG&E shall <br /> I <br /> 25fuse its best efforts to obtain site access agreements from the <br /> 26owners of such property within 60 days of request by the Department. <br /> 271 Best efforts as used in this paragraph shall include, a certified <br /> 'APER <br /> CALIFORNLI 3 0 I IA <br /> REV. 6.721 <br />
