1 Memorandum of Lease against Debtor' s real property. Fully <br /> 2 secured. ( Premises abandoned by the creditor. ) <br /> 3 Class 5 : Unsecured Claims . Class 5 claims shall consist <br /> 4 generally of allowed, unsecured claims not entitled to priority, <br /> 5 including the allowed claims of those individuals claiming damages <br /> 6 under executory contracts or unexpired leases rejected during <br /> 7 the case or pursuant to the Plan. <br /> 8 ARTICLE II <br /> 9 PROVISION FOR PAYMENT OF CREDITOR <br /> 10 Class 1 Claims: Class 1 claims are not impaired under the <br /> 11 Plan and shall be paid in full upon the allowance by the court. <br /> 12 The amounts shall be paid from the realization of funds upon <br /> 13 sale of Debtor' s real property. The amounts shall be paid pro- <br /> 14 rata annually until fully paid as funds are realized from the <br /> 15 sale of Debtor' s real property. <br /> 16 Class 2 and 3 Claims : Class 2 and 3 claims are not impaired <br /> 17 under the Plan and shall be paid as approved or allowed by the <br /> 18 Court. The amounts shall be paid pro-rata annually until fully <br /> 19 paid as funds are realized from the sale of Debtor' s real <br /> 20 property. <br /> 21 Class 4 : Claims Secured by Real Property. Class 4 shall <br /> 22 include all claims allowed as claims secured by contractual <br /> 23 liens and encumbrances upon real property of the Debtor to the <br /> 24 extent secured. <br /> 25 Class 4A: Tax Collector of San Joaquin County. This claim <br /> 26 is a fully secured claim for real property taxes in the approxi- <br /> 27 mate amount of $13 ,500 .00 . This claim is not impaired and shall <br /> 28 be paid out of escrow upon the sale of Debtor' s real property. <br /> -4- <br />
