The owner or operator of an underground storage tank with a spill containment structure designed to prevent a release in the event of a spill or overfill while a hazardous substance is being placed in the tank shall annually test the spill containment structure to demonstrate that it is capable of containing the substance until it is detected and cleaned up. -> Spill container testing was due by September 2005 and was not performed until October 28, 2005, one month late. 4 Spill container testing was due by October 2006 and was not performed until November 26, 2007, 13 months late (testing was performed on November 15, 2006, by Shirley Environmental, but the EHD was not notified, and is therefore, invalid). Owners or operators of underground storage tanks subject to this section shall implement a monitoring program approved by the local agency and specified in the underground storage tank operating permit. The program shall include interstitial space monitoring as described in subsection (c) and shall include the items listed in subsection (d). 4 This facility did not have monitoring and response plans at the time of the November 13, 2003, routine UST inspection.
