An oil spill was <br /> found on the ground surrounding the used oil tank. A tank system or secondary containment system from which <br /> there has been a leak or spill, or which is unfit for use, shall be removed from service immediately, and the owner or <br /> operator shall satisfy the following requirements. <br /> a. general emergency procedures as required in section 66265.56 <br /> b. cessation of use; prevention of flow or addition of wastes <br /> c. removal of waste from tank system or secondary containment system <br /> d. the owner or operator shall immediately conduct a visual inspection of the release and, based upon that <br /> inspection <br /> e. notifications, reports <br /> f. provision of secondary containment, repair, or closure. <br /> g. certification of major repairs <br /> Immediately respond to this spill and ensure that these spill response requirements are part of the facility response <br /> plan and that all employees are fully trained that are responsible to carry out any of these requirements. The active <br /> leak was due to the faulty overfill device on the waste oil tank that has since been corrected by Sheldon Phillips. <br /> This is a Class II violation. <br /> 601 CCR 66262.34(a) Stored hazardous waste on site longer than 90 days without a permit or authorization. <br /> A black 55 gallon container of waste paint from the aerosol can puncturer was on site longer than 90 days. The start <br /> accumulation date on the container was December 9, 2014. Facilities who generate more than 1000 kg of hazardous <br /> waste per month may store waste on site up to 90 days. Immediately contact a licensed hazardous waste hauler to <br /> dispose of this waste under manifest and submit a copy of the manifest to the EHD. <br /> This is a repeat violation, Class Il. <br /> 605 CCR 66262.34(f) Failed to completely label containers or tanks of hazardous waste. <br /> An orange container of used oil on the east side of the facility was not have a hazardous waste label. A blue container <br /> of used oil on the south side of the facility did not have a hazardous waste label.
