Inspection Report <br /> ARP Enterprises <br /> Page 3 <br /> Department for a permit for storage longer then 90 <br /> days. <br /> Mr. Arp explained to me that he had been <br /> accumulating the paint/water mixture for about <br /> five years. He informed me that he had never <br /> removed . any of the waste and that the tank had <br /> never gotten full. <br /> 4. Title 22, Cal Code Regs. , Section 67257 (e) <br /> Arp Enterprises violated Title 22 , Cal. Code <br /> Regs. , Section 67257 (e) in that on or about <br /> December 7, 1988 Arp Enterprise' s uncovered tank <br /> did not have at least 60 cm (2 feet) of freeboard. <br /> On December 7, 1988 when I inspected Arp <br /> Enterprises ' uncovered tank. At that time there <br /> was approximately 6 inches of freeboard. There is <br /> no secondary containment for this tank. <br /> 5. Health and Safety Code, Division 20, Section <br /> 25189 (d) <br /> Arp Enterprises violated Health and Safety Code, <br /> Section 25189 (d) in that on or about December 7, <br /> 1988 Arp Enterprises had negligently disposed of <br /> hazardous waste to the soil. <br /> On December 7, 1988 when I inspected Arp <br /> Enterprises uncovered storage tank I noticed that <br /> the soil surrounding the tank had the same reddish <br /> color as the material within the tank. In <br /> addition the drain spout that drains the <br /> paint/water mixture from the paint reservoir <br /> drains directly to the soil. This soil had the <br /> same reddish color as the material in the tank. <br /> VIII. Observations <br /> On December 7 , 1988 at approximately 1100 Mr. Favila <br /> from the SJCHD and myself arrived at Arp Enteprises to <br /> conduct an inspection. Mr. Wayne Arp met us and asked <br /> if we could come back that afternoon because he was in <br /> the middle of a meeting. Mr. Favilla informed me that <br /> he would not be able to return that afternoon. I <br /> informed Mr. Arp that I would return late that <br /> afternoon. <br /> I returned to ARP Enterprises at 1500 on December 7, <br /> 1988. Mr. Arp met with me and I explained to him that <br /> I was investigating a referral from SJCHD. Mr. Arp <br /> said that he had been told by Mr. Favilla when he was <br /> out there in August that someone from the state would <br />
