JOHN C. SHAUGHNESSY
Suite 33-142
4555 N. Pershing Avenue JUL 10 1992
Stockton, CA 95207
( 2 0 9 ) 957-0740 ENVIRONMENTAL H
EALTH
PERMIT/SERVICES
July 10 , 1992 fJy/
Doug Wilson
Public Health Service
County of San Joaquin
P.O. Box 2009
Stockton, CA 95201
Re: Vintage Car Wash
Dear Mr. Wilson:
I have read the letter from Pete Giambanco dba Vintage Car
Wash, dated June 29 , 1992, and feel the record should be set
straight with some truth. Mr. Giambanco has given you some
misstatement of facts in order to attempt to exonerate him-
self from his inability to have successfully operated the car
washes and gas stations that he purchased from me. I make
the following points in response to his letter:
1) Mr. Giambanco learned in October 17 to November 17 ,
1990, that gas had leaked from tank #3 , the regular unleaded
tank. He learned this from his daily readings taken there.
There were in fact 3 , 200 gallons of gas that escaped and his
own records reflect that all of that gas escaped after he
purchased the facility at 601 E. Miner Avenue on August 15 ,
1990 . That is the date at least that he took possession.
His own employee, Michele Sturgeon has testified under oath
that she was told by management to pound the dip stick hard
enough to get it over a lip that allegedly existed. There
was no lip and she followed orders . Contrary to his state-
ment, Mr. Giambanco only made efforts to sell after he and
his employees contaminated the property. He could hardly
hide the fact of contamination from Wiggins & Associates
since Michele Sturgeon herself turned Mr. Giambanco into
the County shortly after November 17 , 1990, and the County
inspected the site on December 4 , 1990 . He didn ' t need to be
instructed by Wiggins to test for contamination. He had al-
ready told one or more of his employees prior to this time
that if anyone asked why tank #3 was not operational, to tell
them that they were just waiting to convert it to diesel---
an obvious , outright lie.
2 ) Mr. Giambanco states that he then on his own tested
for contamination of Pacific Avenue . He tested Pacific Avenue
