Violating Health and Safety Code section 25504(c), failing to provide training for <br /> 3 all new employees and annual training, including refresher courses, for all employees in safety <br /> 4 procedures in the event of a release or threatened release of a hazardous material, including,but not <br /> 5 limited to, familiarity with the plans and procedures specified in Health and Safety Code section <br /> 6 25504(b); <br /> 7 d. Violating Health and Safety Code section 25505, failed to submit a business plan <br /> 8 for emergency response to a release or threatened release of hazardous material within four(4) years <br /> 9 prior to the filing of this COMPLAINT for 717 W. 8TH STREET, STOCKTON, CALIFORNIA,to <br /> 10 the San Joaquin County Office of Emergency Services. Further, it is alleged that said violation was <br /> 11 knowingly committed after reasonable notice; <br /> 12 e. Violating Health and Safety Code section 25505(e)(2), failed to annually submit a <br /> 13 form,provided by the San Joaquin County Office of Emergency Services,that certifies that the <br /> 14 handler has included, and maintains as current, in the business plan, all other information required <br /> 15 by Health and Safety section 25504. <br /> 16 6. Defendant, in the course of Defendant's RETAIL GASOLINE STATION activities, are <br /> 17 pursuant to Business and Professions Code section 17204 hereby are permanently enjoined from: <br /> 18 a. Violating Health and Safety Code section 25280 et seq., as described in paragraph <br /> 19 3 - 3j above. <br /> 20 b. Violating Health and Safety Code section 25100 et seq., as described in paragraph <br /> 21 4 - 4a above. <br /> 22 c. Violating Health and Safety Code section 25500 et seq., as described in paragraph <br /> 23 5 - 5e above. <br /> 24 7. Defendant shall pay to Plaintiff the sum of FOURTEEN THOUSAND DOLLARS <br /> 25 ($14,000.00), as and for civil penalties,pursuant to Health and Safety Code §25299. Said payment <br /> 26 shall be made payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH <br /> 27 DEPARTMENT- ENVIRONMENTAL HEALTH DIVISION TRUST. Said payments shall be <br /> 28 delivered to the San Joaquin County Office of the District Attorney, Environmental Prosecutions <br /> -4— <br /> PERMANENT INJUNCTION AND FINAL JUDGEMENT PURSUANT TO STIPULATION <br />
