SANJ O A Q U I N Environmental Health Department <br /> UNTY— <br /> Complaint Record Daily Time and Activity Summary from 3/1/2015 to <br /> 6/21/2034 for C00042166 located at <br /> BYRON & WICKLUND <br /> Activity Date Recorded by <br /> 09/01/2016 Please refer to DA1459561 Daily entry for the previous details for this incident. At PE 2546 SAEED <br /> Oso min 0814 1 notified Valley Com. that I am on my route to the incident. I arrived on SC 544 <br /> scene at 0825 and notified Valley Com. When arrived on scene, CHP, Eric Gatty <br /> was on scene and the towing company. The towing company started the clean-up. <br /> However, a proper clean-up was not completed. I told the towing company that <br /> more clean-up is required due to soil contamination and the pavement stains; they <br /> told me that they do not have more absorbent. I told them the responsible party <br /> needs to hire a hazardous waste clean-up company to clean-up, dispose, and haul <br /> the waste properly. At 0903 1 called Kasey and update her about the status of the <br /> incident. Kasey told me to get the RP information, and Elena Manzo will respond <br /> later to carry on with the incident investigation. I talked to the driver, Francine <br /> Matte. Francine told me while she was driving this morning (still dark), she <br /> accidently ruptured the fuel tank because the rail road level was too high. She told <br /> me about 40 gallons of Diesel spilled. I collected the information of the RP/truck <br /> company( Liason CAN/US. Logistics INC. , 9936, CH DE LA Cote- De- Liesse, <br /> Lachine, QC H8T 1A1). I asked the driver if they have an office or a contact in the <br /> U.S, and I was told no. I was given the General Admin. (Richard Legros, phone <br /> number to contact. I called Richard and I was told that their office is in Canada. I <br /> explained the situation to Richard and told him that he needs to hire a hazardous <br /> waste contractor to clean-up the spill. Richard asked me to call a contractor for <br /> them to do the clean-up. I told Richard we do not call the contractors, but he <br /> needs to call a contractor. At 0945 CHP Sergeant Rickman was on scene and told <br /> me to call a clean-up crew; I explained to the sergeant that the RP shall contact a <br /> clean-up company. At 0940 Elena Manzo arrived on scene and I discussed the <br /> situation with her. At 09521 called Richard to ask for updates on calling up the <br /> clean-up contractors, and I was told by Richards that the driver, Francine told him <br /> not to call a clean-up contractor anymore because CHP told them if they cannot <br /> find one, EHD will call a contractor. I told the driver, EHD is not a calling a <br /> contractor, the RP need to do it. I called Richard and told him that if he could not <br /> find a clean-up contractor, I can text him a list of contractor he can choose from. I <br /> discussed the situation with CHP and told them EHD is not calling the contractor, <br /> but the RP responsibility to call them. I texted the contractors list to Richard, and I <br /> confirmed receiving it. At 1016 1 called Richard to check the status. Richard told <br /> me that he called Ponder Environmental Services, and they should be on scene <br /> within 1-2 hours. I updated Elena on the status. A notice to abate was issued to <br /> the driver by Elena. Elena left to respond to another incident, and I waited for the <br /> clean-up contractors. <br /> At 1230 Jose Colin with Ponder Environmental arrived on scene and we discussed <br /> the clean-up. Jose told me the trailer for the clean-up/equipment should arrive <br /> within 30 mins. At 1248 Ponder Environmental trailer arrived and they started the <br /> clean-up. <br /> I explained our expectation to the contractors. At 1430 1 called Muni and told him <br /> that I am leaving the scene to use the restroom and have lunch. AT 1433 1 left the <br /> scene and notified Valley Com.. At 1510 1 returned to the incident scene and the <br /> contractors asked me if the need to do additional clean up, and I told them yes. I <br /> told the contractors to apply more absorbent to the stained asphalt and to shovel <br /> all the contaminated Soil. At 1530 1 sent photos to Kasey to get her opinion if more <br /> clean-up is required. I told Kasey that all the contaminated soil was removed, but <br /> some of the asphalt is still stained. Kasey told me she is not going to require the <br /> contractors to dig the asphalt, and the clean-up should be fine at this stage. <br /> Seven drums of Hazardous Waste were collected and labeled as hazardous <br /> waste. I took a photo of the shipping manifest. At 1623 1 called SJC PW Road <br /> Maintenance and told them that the clean-up is done. I was asked by SJC PW <br /> Road Maintenance to put the signs aside and they will send notification to open <br /> Page 2 of 3 <br />
