DE1a'IN)UONS <br /> The following terms sball have the meanings set forth below, unless the context clearly <br /> iadiones otherwise, Some of the terms stay be used in either singular or plural,and the use of <br /> singular shall include the plural,and of the plural the singular,as the omtext may require, <br /> 1.1 "Agreement"mean tins Cost Sharing Agreement, <br /> 1.2 "Agency"or "Agencies" shall mean San Joaquin Public Health Services Department <br /> or other government agencies having jurisdiction over the Work and Contamination <br /> (which turns are defined bclow). <br /> 1.3 The"Board"shall mean the State Water Resources Control Board <br /> 1.4 "Contamination" shall mean the petroleum hydrocarbon, motor W,used or waste <br /> oil or other service station operations-reblod substarices or waste products occurring <br /> on or under the Stations(as defined below),in tate soils or groundwater on or under the <br /> stations and/or such contamination which has nugrated fiUM the sails and/or <br /> gmundwater on or under the Stations so as to contaminate or affect the surrounding <br /> areas. <br /> V5 "Costs" shall mean the costs, expenses and/or expenditunss, whether eligible or <br /> ineligible for reimbursement from the Underground Storage Tank mmd, mcurred by <br /> the parties in accomplishing the Work (as defined below) contemplated by this <br /> Agreement. Costs shall not include in-house costs and expenses_ <br /> 1.6 "Investigation" shall mean, without limitation, the inspection. testing, monitoring, <br /> analysis and other activities taken under this Agreement by the patties to dewmline the <br /> presence, type,concentration,extent or other parameters ofdw ConUanvtafion <br /> 1.7 "Joint Consultant" shall mean an cnvkoMnertW consulting firm acceptable to all <br /> parties_ <br /> 1.8 The terms"party"and "parties" shall refer to Chevron andlor ARCO,as the context <br /> requires. <br /> 1.9 "ROative Contribution" shall mean the proportion of Contamination that was <br /> caused by or resultcd from the operations of each party at its respective Station <br /> 1.10 "Remediation" shall mesio the trcairnent an&or rwwval of the Contamination or any <br /> soils or groundwater affected by the Contamination from the Stations or surrounding <br /> areas as may be required by the Agencies,or voluntarily undertaken by agroement of <br /> the parties. <br /> 1.11 "Remediation Plans" shall mean,the proposal submittedby the prntiw to the <br /> ,Agencies which set forth how and when the Work will be done. <br /> i <br /> 2 <br /> I <br />
