The Spill Prevention, Control, and Countermeasure(SPCC)Plan does not follow the order or requirements in 40 CFR Part 112, and a cross-reference was not provided. The management commitment certification page is not signed. If you are the owner or operator of a facility subject to this part you must prepare a Plan in accordance with good engineering practices. The Plan must have the full approval of management at a level of authority to commit the necessary resources to fully implement the Plan.You must prepare the Plan in writing. If you do not follow the sequence specified in this section for the Plan, you must prepare an equivalent Plan acceptable to the Regional Administrator that meets all of the applicable requirements listed in his part, and you must supplement it with a section cross-referencing the location of requirements listed in this part and the equivalent requirements in the other prevention plan. Immediately amend the SPCC Plan to include a cross-reference or to follow the required sequence and ensure the mangement commitment page is signed. This is a minor violation. 609 CFR 112.7(a)(3vi), 112.7(a4)Plan failed to adequately contain procedures for reporting a discharge. The Spill Prevention, Control, and Countermeasure(SPCC)Plan does not provide information and procedures to enable a person to adequately report a discharge. The CAL OES phone number listed in the SPCC plan is not the 24 hour emergency number. If a response plan was not submitted to the Regional Administrator, this information must be included in the SPCC Plan. Immediately amend the SPCC Plan to include this information and submit a copy of the revision to the EHD. This is a minor violation. 611 CFR 112.7(b) Plan failed to include a description of potential equipment failure or provide equivalence. Potential equipment failure and the resulting spill for all tanks was not addressed in the Spill Prevention, Control, and Countermeasure (SPCC) Plan. The SPCC Plan must include a prediction of the direction, rate of flow, and total quantity of oil which could be discharged from the facility as a result of major equipment failure. Immediately amend the SPCC Plan to include this information and submit a copy of the revision to the EHD, or provide equivalence as allowed by 40 CFR 112.7(a)(2). This is a minor violation. 619 CFR 112.7(f)(1) Failed to train personnel on all discharge prevention details listed in this section. Oil handling personnel were not trained. At a minimum, oil handling personnel shall be trained in the operation and maintenance of equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and regulations; general facility operations; and the contents of the Spill Prevention, Control, and Countermeasure Plan. Immediately provide this training to all oil handling personnel and submit a copy of the training log to the EHD. This is a Class II violation.
