Mr. Brian Walker '- - 2 - 10 August 1999 <br /> Based on tiese results,the release from the former underground storage tank at the site can now be <br /> considered to be a low threat to water quality and qualifies for an NFA status. However,newly enacted <br /> legislation(AB 681 -Machado,which modified Section 25297.1 and 25297.15 of Chapter 6.7 of the <br /> Health ane Safety Code, effective 1 January 1999)requires that all responsible parties notify all current <br /> record owners of fee title to the site of any corrective action or site closure proposals submitted to the lead <br /> agency(R(:gional Board).Furthermore,the responsible parties must certify to the Regional Board, in <br /> writing, that the notification requirement has been met, and include a complete mailing list of all record <br /> owners of fee title. The written certification must include proof that the owners of record have been sent <br /> notice(certified mail receipts or other proof mechanisms). <br /> Before we can issue an NFA letter,we also need proof that all MWs at the site have been destroyed in <br /> accordance with California Well Standards, California Department of Water Resources Bulletin 74-90 and <br /> other requirements that the San Joaquin County Public Health Services may require. During a telephone <br /> conversation with staff on 5 August 1999,Mr. Santochi stated that Mr. Mike Infurna of the San Joaquin <br /> County Public Health Services requested that at least one of your MWs be retained for monitoring a site <br /> upgradient of your property.
