..1 1 I July 2007 AGE -NC Project No. 03-1055 Page 3 of 4 were made for property improvements in 1973 or following years. • 16 March 1972 (Deed): The property was deeded by Leona Kelly et al to Alfred A Souza and ,Joann Panagos. • 10 July 1974 (Deed): The property was deeded by Alfred A Souza and Joann Panagos to Carey Joann Panagos. • 21 ,lune 1979 (Deed): The property was deeded by Carey ,loann Panagos to John and Helen Pikoulas and John Tsinglieris. • 26 March 1980 (Deed): The property was deeded by John and Helen Pikoulas and John Tsinglieris to James, Julie and Matina Lembesis. • 22 February 1999 (Deed): The property was deeded by James, Julie and Matina Lembesis to J1_,N Farms, Douglas, Brenda and Harley Murray et al. • 15 February 2001 (Deed): The property was deeded by JLN Farms, Douglas, Brenda and Harley Murray et al. to Joseph and Rosanna Panetta. CONCLUSIONS Based upon research performed, AGE has the following conclusions: • Lease Agreements for a service station (land and improvements) on the subject property were recorded between Tide Water Associated Oil Company and James and Lenore Kelly in 1955 and between Tidewater Oil Company and the Lenders Investment Corporation in 1956. Both lease agreements included indemnification clauses rendering the Lessee responsible for resolving damage to the property from service station operations. • Tidewater Oil Company transferred the subj ect property lease, among other leases, to Phillips Petroleum in 1966, Phillips Petroleum agreed to accept the conditions of the assigned leases. • The lease between Phillips Petroleum and Lenders Investment Corporation (1956) was terminated in July 1971. AGE did not find a Lease Termination Agreement for the 1955 lease. • Directory listings show the property operating from 1956 through 1969 as Gill's Flying A/Gill 's Phillips 66 Gas and from 1969 through 1970 as Art's Phillips 66 Gas at 33 West 1 1'h Street.
