i Permits and Protection of Underground Utilities Before undertaking any <br /> acti%ity on the Property, Contractor shall obtain or cause to be obtained all permits that may be <br /> required by any governmental or regulatory agency and pay any fees, costs, charges or expenses <br /> required to obtain or carry out such permits and identify the location of all underground utility <br /> lines. Contractor shall, prior to their submission or issuance, deliver copies of all applications for <br /> permits to Owner for Owner's review and comment and obtain Owner's approval of said <br /> applications, which consent shall not be unreasonably withheld Owner shall be deemed to have <br /> approved of said applications unless Owner notifies Contractor of any objections to the <br /> applications within two (2) business days after receiving its/their copies of the applications <br /> 3 OWNER COVENANTS Owner has notified any other tenant, easement holder, <br /> licensee, or other individual who is not a signatory hereof, and who has any contractual right or <br /> legal interest in ownership, use or control of any part of the Property, and has secured from each <br /> such person permission to grant this license <br /> 4. WARRANTY OF AUTHORITY Contractor warrants that the individual <br /> signing on its behalf has been duly authorized by all requisite corporate action to execute this <br /> Agreement on behalf of the Contractor and that the individual designated as the Responsible <br /> Person pursuant to Section 2(b)(1) has full and complete authority to bind the Contractor in <br /> connection with all matters pertaining to the Permitted Work. <br /> 5 REGULATORY AUTHORITY NOTICES Contractor shall promptly give <br /> Owner a copy of any notice, correspondence or information it receives from any federal, state or <br /> other governmental or regulatory agency regarding any air, soil or ground water contamination <br /> on, under or about the Property or such contamination which affects or may affect the Property, <br /> or regarding any actions instituted,completed or threatened by any such governmental authority <br /> concerning any air, soil or ground water contamination which affects or may affect the Propem. <br /> b.
