The proposed project appears to be <br /> in compliance with the Special Purpose Plan. <br /> Setback Requirements <br /> Development Title Sections 9-1022.2 & 9-410.5 state that fences shall be set back a <br /> minimum of twenty (20) feet from the front and street side property lines in the C-C zone. <br /> All storage materials and related activities, including storage areas for trash, shall be <br /> screened so as not to be visible from adjacent properties and public rights-of-way. <br /> Screening shall be six (6) to seven (7) feet in height. Outside storage is not permitted in <br /> front yards, street side yards, or in front of main buildings. The trash enclosure is <br /> currently ten (10) feet from Douglas Road. As a result, the trash enclosure will need to <br /> be relocated. <br /> Building Department <br /> Because the canopy is proposed for construction along the northern and western <br /> property lines, the Building Department is requiring the applicant to comply with one of <br /> the following three conditions: <br /> • For exterior walls less than twenty (20) feet from the property line, a one (1) hour <br /> fire-resistive wall shall be constructed; or <br /> • Remove the property lines by merging both properties; or <br /> • Secure an irrevocable non-building easement within twenty (20) feet of the <br /> proposed canopy. <br /> State Clearinghouse <br /> The project has been referred to the State Clearinghouse for review (SCH# <br /> 2003042148). The review period ends on May 23, 2003. The Community Development <br /> Department cannot approve the project until after May 23, 2003. The Community <br /> Development Department has reviewed the Site Approval application and responses <br /> from other agencies and provided no additional issues arise, will be recommending <br /> approval subject to the following Conditions of Approval: <br /> Site Approval Application No. PA-03-131 was approved by the Community <br /> Development Department on . The effective date of approval is . This approval will <br /> expire on , which is 18 months from the effective date of approval, unless (1) all <br /> Conditions of Approval have been complied with, (2) all necessary building permits <br /> have been issued and remain in force, and (3) all necessary permits from other <br /> agencies have been issued and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements <br /> shall be fulfilled prior to the establishment of the use and the issuance of any <br /> building permits. Those Conditions followed by a Section Number have been <br /> identified as ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified, and other ordinance requirements may apply. <br /> 2 <br />
