EHD cannot approve that. By
moving the excavated soils without sampling to prove the soils are NOT HAZARDOUS, you may be endangering
your work.
If Forward can extend some coverage of this requirement since you plan to dig and haul to them, fine with
EHD..Without this'extension' EHD cannot approve the transport of soils/gw.
Even dig and trans to next door maybe a problem if you travel on 11th street, even if for 100 feet..A CHP may
have a problem with that and EHD cannot approve/waive the self cert for this either.
EHD does approves the Pub Part period as succesfully completed. The plan that was'tentatively' approved is
now finally approved. You may submit the schedule to enact the TRAP.
Sorry for the 'non-approvals', but I don't have the authority to waive this T-22 req. You need to adequately
address this.
let me know your decision.
Think about dig and loading onto steel 'bins' like demo sites use.. Hold the soils, sample for 24-hour TOT, and if
non-HAZ, you can just load the bins to Forward. HAve enough bins to load one day and haul the next day...I CAN
approve this.....
-----Original Message-----
From: John Lynch [mailto:lynch@inreach.com]
Sent: Tuesday, November 11, 2003 2:44 PM
To: Mike Infurna [EH]
Cc: Dennis Cox; Janice Brown; Gary Cox
Subject: Cox and Cox, 595 11th Street-IRAP
Mike,
Two tenants contacted me through the property owner Earl during the public comment period.
One was concerned about loss of her plants and being displaced overnight because she has a cat to
take care of I explained to Earl that we would do our best to salvage her plants and replant them
and replace if needed. Additionally we would put her up in a local hotel/motel and that we would
do our best to get her cat in the hotel/motel with her. If that did not work we would pay for her
cat going overnight to a kennel. This seemed to address her concerns. If needed I could get her
unit number of the lady from Earl, (she lives in the second unit just west of and beside MW-3.
The second concerned tenant was the auto repair facility to the east and beside MW-3. He was
concerned about access to his shop during excavation work. We indicated that we would phase
the digging. First digging at MW-9 and then towards MW-3 thereby leaving him access from
eastern most entrance of I 1 th Street into his southern most service bay. We would then work as
required around MW-3 leaving him access from the western most entrance through the trailer park
and to his northern most service bay. This satisfied his concerns.
Are there any other concerned parties that I am not aware of and need to do anything with and or
11/12/2003
