Bartel <br /> and Nash. While it is refreshing to see that you are finally <br /> beginning to' undertake some efforts to remediate the significant <br /> toxic contamination of the Site, it is my no means clear from <br /> your letter and its enclosures what effect the proposed lilaited <br /> remediation will have. <br /> Section 9.1 of the Lease does not give you, as landlord, the <br /> right to enter onto the premises to excavate and remove soil as <br /> proposed in the work plan. it allows you onto the Premises at <br /> "reasonable times for the purpose of inspection, maintenance, <br /> making repairs, alterations or additions to any portion of the <br /> Building . . . 11 and requires that you " . . make reasonable <br /> efforts to minimize any inconvenience to Tenant . . ." in <br /> exercising your rights. There is nothing in there that gives you <br /> the right to dig up the Premises and disrupt Tracy Chevrolet's <br /> business. <br /> Nevertheless, in a spirit of cooperation and in view of our <br /> repeated demands that you take steps to alleviate the severe <br /> environmental pollution on the Site, my client consents to <br /> allowing your contractor, under the supervision of Horizon <br /> SR1\92D27.1\AR1 <br /> 22/hT'd INS3fbW SN3d3d WH9S:TT 96, 92 33Q <br />
