Development projects consistent with the Special <br /> Purpose Plan,that do not exceed the intensities listed above,will be permitted with ministerial review <br /> according to the process described in the staff report. Should the overall intensities be exceeded,then <br /> additional environmental review will be required as part of an amendment to the Special Purpose Plan. As <br /> long as projects are consistentwith the Plan and within the intensities used in the Initial Study for the Plan, <br /> no further environmental review is required. <br /> Biological Resources: <br /> The EIR and the subsequent Negative Declaration noted that development of the project may have adverse <br /> impacts on various listed species, including the Swainson's hawk and the burrowing owl. As required. <br /> mitigation,the applicant or developer may pay a fee to the San Joaquin County Council of Governments <br /> pursuant to the San Joaquin County Multi-Species Habitat Conservation and Open Space Plan. If the <br /> Countywide HCP is not adopted, mitigation consistentwith the requirements of the Department of Fish and <br /> Game will be required.
