The BO <br /> describes the incidental take actions,terms and conditions(i.e., mitigation <br /> requirements) and monitoring for fairy shrimp species. In addition, a Memorandum <br /> of Understanding(MOU)was executed between the Federal Aviation Administration <br /> (FAA),Federal Highway Administration(FHWA),and the Stockton Metropolitan <br /> Airport(SMA) in April 1999 further identifying responsibilities for mitigating fairy <br /> shrimp impacts. It should also be noted that potential issues involving burrowing <br /> owls will be resolved through mitigation prior to construction activity. <br /> Airport Master Plan Mitigation: <br /> Mitigation Measure VW-4A: Compensate for the loss of Swainson's hawk foraging <br /> habitat -OR- <br /> Mitigation Measure VW-413: Participate in the San Joaquin County Habitat <br /> E Conservation Plan to mitigate for the loss of Swainson's hawk foraging habitat. <br /> Airport Master Plan Mitigation: <br /> Mitigation Measure VW-5: Consult with the California Department of Fish and <br /> Game to identify and implement mitigation measures for potential adverse effects on <br /> nesting Swainson's hawks. <br /> Airport Master Plan Mitigation: <br /> Mitigation Measure VW-6: Participate in the SJMSCP to mitigate for impacts on <br /> burrowing owls' foraging and nesting habitat. <br /> Airport Master Plan Mitigation: <br /> Mitigation Measure VW-7: Conduct a survey for nesting raptors and avoid nest <br /> trees. <br /> t b) Have a substantial adverse effect on any riparian habitat or other sensitive <br /> natural community identified in local or regional plans,policies,or regulations, <br /> or by the California Department of Fish and Game or U.S.Fish and Wildlife <br /> Service? <br /> Less than significant impact. Impacts to freshwater marsh habitat associated with <br /> the New Weber Slough and seasonal pools have been previously mitigated in <br /> conjunction with the Airport Master Plan, Arch Road/SR-99 Interchange, and Qantas <br /> Lane Extension projects. The U.S.Army Corps of Engineers(Corps) issued an <br /> individual permit(IP 199600332)to the SMA for impacts to jurisdictional waters. <br /> The California Department of Fish and Game(DFG) issued a Streambed Alteration <br /> Agreement(II-707-96).for the Weber Slough diversion. A detailed mitigation plan <br /> has been adopted by these agencies and will be implemented in the fall of 2000.
