�4 4 <br /> Mitigation Measure VW-5: Consult with the California Department of Fish and Game and <br /> Identify and Implement Mitigation Measures for Potential Adverse Effects on Nesting <br /> rill ' Swainson's Hawks <br /> DFG has recommended guidelines to mitigate for project-related impacts on nesting <br /> Swainson's hawks (California Department of Fish and Game 1994). The Department of Aviation <br /> . i shall consult with DFG to identify specific measures to be implemented. DFG recommends that no <br /> disturbance occur within a 0.5-mile radius of active nests between March 1 and September 15, or <br /> August 15 (if a management authorization is obtained for the project). In order to avoid impacts on <br /> nesting Swainson's hawks, DFG may require that preconstruction surveys for Swainson's hawks be <br /> conducted if project-related activities will occur between March 1 and September 15. Additionally, <br /> t local DFG biologists with knowledge of active Swainson's hawk nests should be contacted. If an <br /> active Swainson's hawk nest occurs on the project site or within 0.5 mile of the project boundary, <br /> DFG may require that construction should be avoided until the young have fledged. If construction <br /> or other project-related activities that may cause nest abandonment or forced fledging are necessary <br /> zone, DFG may ire monitoring within the 0.5-mile buffer zo , y re uq g <br /> of the nest site. If the nest is <br /> - abandoned and nestlings are still alive, DFG may require that the Department of Airport fund the <br /> recovery and hacking (training of raptors to fly freely) of the nestlings. <br /> Impact VW-11: Potential Loss of Burrowing Owl Nesting and <br /> Foraging Habitat <br /> Implementation of the project may result in direct mortality of burrowing owls or the loss <br /> of burrowing owl foraging habitat(fallow fields and irrigated pasture)or burrows used for nesting. <br /> k This impact is considered significant because the burrowing owl is a species of special concern and <br /> P, is protected by the federal MBTA and California Fish and Game Code(Sections 3503, 3503.5, and <br /> 3800). The loss of agricultural fields that provide potential foraging habitat for burrowing owls or <br /> the loss of burrows would also be considered a significant impact. <br /> Establishment of conservation easements around areas known to be used by burrowing owls <br /> is one potential means of mitigating for this impact. However, the Department of Aviation has <br /> determined that this is impractical. Implementation of the following mitigation measure would <br /> reduce this impact to a less-than-significant level. <br /> . } Mitigation Measure VW-b: Participate in the SJMSCP to Mitigate for Impacts on Burrowing <br /> Owls' Foraging and Nesting Habitat <br /> l The Department of Aviation shall participate in mitigation as part of the SJMSCP, which is <br /> currently being reviewed by the agencies and will be available in the near future (Augustine pers. <br /> comm.). The SJMSCP provides the Department of Aviation the opportunity to mitigate for impacts <br /> on burrowing owls' foraging and nesting habitat by fee acquisition.
