Under the terms of the <br /> SWSOM agreement, the City is required to assume all water supply operation and maintenance <br /> � responsibilities within the South Stockton Water Plan area, which includes the Stockton <br /> E" <br /> ^ Metropolitan Airport. The City is to provide the water service, but the County, with establishment <br /> of a new County Service Area, will be responsible for constructing, operating, and maintaining <br /> distribution facilities on the airport property. No changes to the DEIR are required. <br /> a <br /> Response to Comment 1-15. Refer to Responses to Comments 1-5 and 1-11. Under the terms of <br /> the SWSOM agreement, the City is obligated to provide water to the project site. In the south Stockton sewer service area, the City generally <br /> provides sewer capacity to new development through annexation to the South Stockton Community <br /> # Facilities District (CFD). However, because the airport is exempt from annexation to the CFD, it <br /> was necessary for the City and the County to reach an agreement on an equitable connection.fee in <br /> lieu of the charges for annexation to the CFD. The Stockton City Council adopted the Airport Area . <br /> r In-Lieu Fee for airport sewer connection on July 1, 1996..* -The County Board of Supervisors <br /> approved the fee on July 9, 1996. The Airport Area In-Lieu Fee is composed of a treatment facility i <br /> :portion and a collection system portion. Pages 3-13 and 10-6 have also been modified to identify <br /> the in-lieu fee. Because the County has agreed to pay applicable sewer connection fees for <br /> improvements to Stockton Regional Wastewater Control Facility and has agreed to pay in-lieu fees <br /> established For Community Facilities District 90-1, no significant impacts are identified. <br /> Response to Comment 1-18. Mitigation Measure VW-3 is considered adequate mitigation for the <br /> loss of oak trees. County staff and the project engineer will consider the suggestion to realign the <br /> paved route shown in Figure 3-4 between the 27-acre air cargo area and the regional airport terminal <br /> to minimize impacts on existing oak trees.
