LAND USE,PLANS,AND POLICIES <br /> Introduction <br /> This section updates the discussion of General Plan designations and zone classifications,regulatory and <br /> monitoring responsibilities,and Impact A.2 of the 1994 EIR.,regarding loss of agricultural land. The <br /> remainder of the 1994 EIR's analysis of land use,plans and policies,including Impacts and Mitigations <br /> A.1,A.3,A.4,A.5,and A.6,remains�unchanged. <br /> The landfill expansion project analyzed in the 1994 EIR was in a noncontiguous island of the city limits <br /> of the City of Stockton(see section III. Project Description,Background). Because the City of Stockton <br /> proposes to sell the permitted landfill to a private firm,the jurisdiction of the land occupied by the landfill <br /> and proposed expansion area would revert from the City to the County of San Joaquin. This would <br /> change regulatory and monitoring responsibilities from the City to the County,and require changes in the <br /> City's and County's General Plan designations and zone classifications. The project would require a <br /> County General Plan Amendment,change of zone classification,and Use Permit;as well as changes in <br /> the City of Stockton General Plan and zoning designations. <br /> The project would be in the County,and therefore the EIR focuses on its compliance with County plans <br /> and policies,however the City also will use this EIR in its land use plan and zoning changes. Therefore, <br /> this analysis also updates the project impacts with respect to the City's agricultural/open space/habitat <br /> land policies. When the 1994 EIR was being prepared,the City of Stockton was considering the adoption <br /> of an ordinance to mitigate effects of development on agricultural land and habitat,but had not yet taken <br /> final action. Since then, the City of Stockton adopted a Habitat/Open Space Conservation Fee. This <br /> section updates the analysis of Impact A.2 to incorporate the City's Conservation Fee as well as <br /> compliance with relevant County policies. <br /> SettinE <br /> City of Stockton <br /> d Current Land Uses the <br /> As discussed in III. Project Description, Site Description, Project Locationan , <br /> J <br /> existing Austin Road Landfill occupies 182.5 acres. The proposed 219-acre expansion area consists of <br /> three parcels;the 125-acre CYA parcel,the 83-acre Brocchini parcel, and the 11-acre Triangular <br /> Property. <br /> j The Austin Road Landfill is located outside of the city limits of the City of Stockton and is surrounded by <br /> unincorporated County of San Joaquin territory. State law allows cities to annex non-contiguous parcels <br /> up to 300 acres in size if they are used for public purposes. The non-contiguous parcels containing the <br /> existing landfill were annexed by the City from San Joaquin County in 1994. Part of the proposed <br /> expansion area(the Brocchini parcel,the Triangular Property,and the southernmost 20 acres of the CYA <br /> parcel)was annexed in 1997. These annexed parcels total approximately 297 acres.
