Our comments <br /> include the following: <br /> 1: The site map shows that WID's 20 foot wide right of way which is approximately 200 <br /> feet long in the NW quadrant of the site would be encroached upon by the proposed truck stop <br /> development. The easement area contains a 36 inch diameter pipeline and inspection manholes for <br /> the transmission of irrigation water and drainage water. <br /> 2. For any encroachments upon the District right of way of any kind, the District <br /> has a standing encroachment policy. The policy can be amended by negotiation between the <br /> developer and the District resulting in the District issuing an encroachment permit. These <br /> encroachment permits may be issued for facilities that encroach upon the District's ROW under <br /> certain circumstances. The developer should contact the District immediately regarding a proposed <br /> encroachment and should not assume that he will be granted a permit. <br /> 3. The District will hold the developer, owner or contractor responsible for any damage to <br /> District facilities resulting from the construction or operation of the truck stop. <br /> 4. The applicant should contact the District immediately to identify the pipeline and obtain <br /> n ftnal planning.
