The US Army Tracy Defense Depot is about a mile west of Bird Road. This facility is identified in a number of databases, most significantly in the NPL database. This listing is the National Priority List, meaning that the site is on the federal list of EPA "Superfund" cleanup sites. The facility is engaged in producing, treating, and disposing of hazardous and acutely hazardous wastes. The wastes include petroleum products, solvents, pesticides and hazardous heavy metals. Since 1942, all of these materials have impacted the soil, primarily through unlined treatment ponds and pits. Most of the material has been confined to the soil, however chlorinated solvents have affected the groundwater. Based on the results of the EDR report, it was not deemed necessary to further investigate off-site facilities except the Tracy Defense Depot. Based on information obtained from the State's Envirostor website http://www.envirostor.dtsc.ca.gov/, the contaminated soil above the saturated zone has been adequately mitigated. Based on information obtained from the State's GeoTracker website http://geotracker.swrcb.ca.gov/, the groundwater remains impacted by solvents, primarily perchlorethane (PCE). A recent site summary from March of 2012 of groundwater conditions prepared by the State Regional Water Quality Control Board (attached in Appendix H) indicated that the contaminants have migrated north easterly with the direction of groundwater flow, but have not approached the subject Property. Conclusions Present Use of Property The current and recent uses of the Property as agricultural land to raise almond trees appear unlikely to have impacted the Property with a Recognized Environmental Condition (see Section 1.0 for a definition) except as follows: • Agricultural pesticides and other chemicals have been periodically applied to the crops on the Property. The County Agricultural Commission reported that no Pesticide Use Reports have been filed in the last five years, but the owner reports that the agency is mistaken. He indicated that pesticides are used and stored on the site and the Use Reports are filed as required.
