Pursuant to the federal rule, however, reclaimed land may not be subject to storm <br /> water permitting. <br /> According to the Final Rule, Federal Register/VoIume 55, No. 222/Friday November 16, <br /> 1990, the "EPA believes that, as a general matter, areas which have undergone reclamation <br /> pursuant to such laws (SMCRA) have concluded all industrial activity in such a way as to <br /> minimize contact with overburden, mine products, etc." While EPA and NPDES States have <br /> retained authority to designate particular reclaimed areas for permit coverage, it is the <br /> position of KRC that reclaimed portions of the subject facility will not contaminate storm <br /> water runoff. <br /> KRC Aggregate,Inc.operates under San Joaquin County Quarry Excavation Permit Number <br /> QX-86-1. As mandated by the California Surface Mining And Reclamation Act (SMARA), <br /> the operating permit was granted only after the submittal and County approval of a <br /> J reclamation plan for the planned mining activity. The approved reclamation plan directly <br /> addresses the capture and containment of storm water runoff from active mine areas as <br /> C follows. <br /> • 3.1 Reclamation Plan Summary <br /> Site reclamation, as presented in the approved Quarry Excavation Application, dated <br />�'. February 14, 1991, will consist of excavation to the approximate design elevation of the <br /> r <br /> quarry floor, replacement of a soil cover, and vegetative planting. Final reclamation-has <br /> quarry floor elevations designed to transmit surface water to holding or livestock ponds <br /> { constructed in the vicinity of the currently permitted quarry. Rehabilitation will occur in <br /> h phases over the life of the operation. <br /> It is the position of KRC Aggregate that reclaimed land will not be subject t to storm water <br /> runoff monitoring. <br /> Reclamation of a mined-out phase will be undertaken in accordance with the approved mine <br /> t � <br /> plan. The reclamation plan for the Quarry area consists of the construction of fifteen <br /> livestock ponds. Storm water holding ponds will be periodically relocated and designed such that water from the active quarry will be intercepted prior to entering reclaimed land.
