C) include sediment in the young stages of revegetation, and contact with raw materials or overburden (See Section 5.0). 3.0 RECLAMATION SUMMARY The requirements for reclamation of the property subsequent to mining a given phase are well suited to the control of storm water runoff which has come into contact with mined areas. Pursuant to the federal rule, however, reclaimed land may not be subject to storm water permitting. According to the Final Rule, Federal Register/VoIume 55, No. 222/Friday November 16, 1990, the "EPA believes that, as a general matter, areas which have undergone reclamation pursuant to such laws (SMCRA) have concluded all industrial activity in such a way as to minimize contact with overburden, mine products, etc." While EPA and NPDES States have retained authority to designate particular reclaimed areas for permit coverage, it is the position of KRC that reclaimed portions of the subject facility will not contaminate storm water runoff. KRC Aggregate,Inc.operates under San Joaquin County Quarry Excavation Permit Number QX-86-1. As mandated by the California Surface Mining And Reclamation Act (SMARA), the operating permit was granted only after the submittal and County approval of a J reclamation plan for the planned mining activity. The approved reclamation plan directly addresses the capture and containment of storm water runoff from active mine areas as C follows. • 3.1 Reclamation Plan Summary Site reclamation, as presented in the approved Quarry Excavation Application, dated �'. February 14, 1991, will consist of excavation to the approximate design elevation of the r quarry floor, replacement of a soil cover, and vegetative planting. Final reclamation-has quarry floor elevations designed to transmit surface water to holding or livestock ponds { constructed in the vicinity of the currently permitted quarry. Rehabilitation will occur in h phases over the life of the operation. It is the position of KRC Aggregate that reclaimed land will not be subject t to storm water runoff monitoring. Reclamation of a mined-out phase will be undertaken in accordance with the approved mine t � plan. The reclamation plan for the Quarry area consists of the construction of fifteen livestock ponds. Storm water holding ponds will be periodically relocated and designed such that water from the active quarry will be intercepted prior to entering reclaimed land. Thus, only storm water flowing across reclaimed or pristine land will enter the livestock ponds.
