On October 10, 2010, the Community Development Department approved Williamson Act <br /> Notice of Nonrenewal application number PA-1000229 for a 10.2 acre portion of the <br /> proposed project site. Pursuant to the 2010 Notice of Nonrenewal, the 10.2 acre portion of <br /> the project site area which is under contract will expire on March 1, 2020. <br /> Williamson Act and Solar Use Easement <br /> The proposed project site area is currently under the California Land Conservation Act <br /> and is subject to Williamson Act Contract No. 70-C1-10. As a Condition of Approval, the <br /> applicant shall apply for a rescission of the Williamson Act Contract pursuant to <br /> Government Code Section 51255.1, for placement into a Solar-Use Easement pursuant <br /> to Government Code Section 51190 and 51191, for the purpose of restricting the use on <br /> the land to photovoltaic solar facilities. The applicant will work with the Community <br /> Development Department and the Department of Conservation to fulfill this condition. <br /> Council of Governments <br /> San Joaquin County is a signatory to San Joaquin County Multi-Species Habitat <br /> Conservation and Open Space Plan (SJMSCP) and this project is subject to the plan. <br /> Participation in the SJMSCP satisfies requirements of both the state and federal <br /> endangered species acts, and ensures that the impacts are mitigated below a level of <br /> significance in compliance with the California Environmental Quality Act (CEQA). Per <br /> requirements of the SJMSCP, unmapped projects are subject to case-by-case review. <br /> This can be a 90 day process and it is recommended that the project applicant contact <br /> SJMSCP staff as early as possible. <br /> The Community Development Department has reviewed the proposed project and, <br /> provided all outstanding issues are resolved, intends to approve this project subject to <br /> the following conditions of approval: <br /> Site Approval Application No. was approved by the Community Development <br /> Department on . The effective date of approval is . This approval will expire on , <br /> which is 18 months from the effective date of approval, unless (1) all Conditions of <br /> Approval have been complied with, (2) all necessary building permits have been <br /> issued and remain in force, and (3) all necessary permits from other agencies <br /> have been issued and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and ordinance <br /> requirements shall be fulfilled prior to the establishment of the use and the <br /> issuance of any building permits.
