L. The Applicant shall supply and install regulatory signage at each of the Pedestrian <br /> Connections between Tract 3636 and the Mountain House Creek Pedestrian D.G. Path. <br /> Regulatory signage shall match the signage utilized within the Mountain House Creek Park, <br /> and shall be consistent with all Community Approvals including applicable provisions of the <br /> MHCSD Design Manual, and MHCSD Standards. Regulatory signage and locations shall be <br /> reviewed and approved by the MHCSD General Manager. Timing: Condition shall be met <br /> prior to first building permit. Completion time may be modified by the MHCSD General <br /> Manager to reflect construction,weather, budget, or other public interest contingencies. <br /> M. The Applicant shall install an Irrigation System within the area between the Property Line of <br /> Tract 3636 and the Mountain House Creek Pedestrian D.G. Path from Central Parkway to <br /> Estes Way. Irrigation System shall be installed concurrently with the proposed three (3) <br /> Pedestrian Connections. Design shall be consistent with all Community Approvals including <br /> applicable provisions of the MHCSD Design Manual, and MHCSD Standards. Design and <br /> all Construction shall be reviewed and approved by the MHCSD General Manager. Timing: <br /> Condition shall be met prior to first building permit. Completion time may be modified by the <br /> MHCSD General Manager to reflect construction, weather, budget, or other public interest <br /> contingencies. <br /> N. The Applicant shall replant vegetation as necessary, Hydroseed, the area between the <br /> Property Line of Tract 3636 and the Mountain House Creek Pedestrian D.G. Path from <br /> Central Parkway to Estes Way. Landscape shall be installed to provide Green Vegetative <br /> Conditions for Fire Prevention / Suppression. Design and construction shall be consistent <br /> with all Community Approvals including applicable provisions of the MHCSD Design Manual, <br /> and MHCSD Standards. Design, Construction, and Maintenance shall be reviewed and <br /> approved by the MHCSD General Manager. Timing: Condition for design and construction <br /> shall be met prior to first building permit. Completion time may be modified by the MHCSD <br /> General Manager to reflect construction, weather, budget, or other public interest <br /> contingencies. <br /> III. COUNTY COUNSEL <br /> 1. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code,the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, <br /> and employees from any claim, action, or proceeding against the local agency or its agents, <br /> officers,or employees to attack,set aside,void, or annul an approval of the local agency, <br /> advisory agency,appeal board, or legislative body concerning a subdivision,which action is <br /> brought within the time provided for in Section 66499.37 of the Government Code. <br /> IV. ENVIRONMENTAL HEALTH DEPARTMENT (STAFF CONTACT: GREG <br /> OLIVEIRA, 209-468-3854) <br /> 1. The Environmental Health Department has reviewed a Surface/Subsurface Contamination <br /> Report(Environmental Site Assessment)dated October 29, 2001 and a Phase II Environmental <br /> Assessment dated July 9,2002. Because over one year has elapsed since the preparation of <br /> the Surface/Subsurface Contamination Report, an addendum must be submitted to and <br /> approved by the Environmental Health Department prior to recordation of the Final Map. <br /> 2. Submission of three (3)sets of detailed public swimming pool plans to the Environmental Health <br /> Department for review and approval prior to issuance of building permit(s) (Code of Regulations, <br /> Title 22, Section 65505). <br /> 11 <br />
