h. RIGHT TO FARM ORDINANCE: The applicant or builder shall provide each new homeowner a <br /> pamphlet advising the homeowner of the Right to Farm Ordinance and of potential agricultural <br /> nuisances such as odors and noise. This mitigation measure will be completed at occupancy. <br /> The builder will submit proof to the Community Development Department that homeowners <br /> received the pamphlet. <br /> i. SCREENING: Screening shall be provided and comply with the following: <br /> (1) A solid masonry wall or wood in combination with masonry wall six (6) feet in height shall be <br /> erected along the rear of lots 343-378 as shown on page six of the revised vesting tentative <br /> map. Construction may be bonded and phase to coincide with the construction of the <br /> subdivision's streets. (Mitigation Measure 4.1-1) <br /> j. LANDSCAPING: Landscaping shall be provided and comply with the following: <br /> (1) Street trees are required as specified in Section 9-1020.4 of the Development Title. <br /> (2) Where removal of mature oaks is unavoidable, replacement plantings shall be provided <br /> consistent with Section 9-1505.4 of the Development Title. (Mitigation Measure 4.10-2C) <br /> (3) A Tree Preservation Plan shall be submitted as part of the application for a Grading Permit <br /> and shall contain the following: <br /> A. All trees to be retained shall be identified in the field through flagging or other obvious <br /> marking method prior to any grading. <br /> B. Temporary fencing shall be required along the outermost edge of the drip line of each <br /> tree or group of trees to be retained in the vicinity of grading to avoid compaction of the <br /> root zone and mechanical damage to trunks and limbs. <br /> C. Paving within tree drip lines shall be prohibited or stringently minimized, using porous <br /> materials such as gravel, loose boulders, cobbles, wood chips, or bark mulch where <br /> hardscape improvement are necessary for access in the vicinity of trees. <br /> D. Trenching shall be prohibited within tree drip lines, with any required utility line within the <br /> drip line installed by boring or drilling through the soil. <br /> E. Landscape irrigation within tree drip lines shall be minimized, prohibiting turf or any <br /> landscaping with high water requirements and limiting permanent irrigation improvements <br /> to bubbler, drip, or subterranean systems. (Mitigation Measure 4.10-2B) <br /> (4) Native cattails shall be preserved or allowed to become established at a minimum of 500 <br /> linear feet of shoreline to the western lake on Parcel K. (Mitigation Measure 4.10-3) <br /> k. PRE-CONSTRUCTION SURVEYS: A pre-construction survey for raptors shall be conducted by <br /> a qualified wildlife biologist prior to initiation of final grading plans for the project to confirm the <br /> presence or absence of any new nesting activity on the site. If a colony of burrowing owls or tree <br /> nesting raptor is found, appropriate measures shall be taken to avoid destruction of an active <br /> nest. An appropriate buffer zone shall be established around any active nest based on <br /> consultation with representatives of the State Department of Fish and Game. Construction <br /> activities shall be restricted from this zone until a qualified biologist has determined that nesting is <br /> complete and the young have fledged. For non-nesting burrowing owls, passive relocation <br /> methods shall be used by the qualified biologist to remove the owls from the impact area.
