(3) Proposed improvements shall be designed to preserve and enhance marsh and riparian <br /> habitat on the site. Of particular concern are areas of established vegetation along the San <br /> Joaquin River and shoreline of the western quarry lake, shown in Figure 4.10-1. The <br /> following modifications to the project shall be made to preserve and enhance sensitive <br /> habitat: <br /> A. Mature trees shall be preserved in siting improvements associated with the proposed <br /> boat storage facility along the levee. Tree trunk locations shall be mapped by <br /> engineering survey, and access improvements designed around individual trunks to the <br /> maximum extent feasible. <br /> B. Native cattails, shall be preserved or allowed to become established around a minimum <br /> of 500 linear feet of the shoreline to the western lake on Parcel K. (Mitigation Measure <br /> 4.10-3) <br /> (4) Applicant shall informally consult with National Marine Fisheries Service and U.S. Fish and <br /> Wildlife Service to ensure that no permits are required for modifications to in channel habitat <br /> on the outboard side of the levee of the San Joaquin River. (Mitigation Measure 4.10-513) <br /> (5) Any modifications to the outboard side of the levee along the San Joaquin River shall be <br /> coordinated with representatives of the U.S. Army Corps of Engineers and CDFG, and any <br /> necessary permits or authorization shall be obtained by the applicant where required. The <br /> applicant shall confirm that proposed modifications to the lakes on the site are exempt from <br /> jurisdiction by the Corps and CDFG. (Mitigation Measure 4.10-6) <br /> x. COUNTY COUNSEL <br /> (1) HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the J <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, <br /> and employees from any claim, action, or proceeding against the local agency or its agents, <br /> officers, or employees to attack, set aside, void, or annul an approval of the local agency, <br /> advisory agency, appeal board, or legislative body concerning a subdivision, which action is <br /> brought within the time provided for in Section 66499.37 of the Government Code. <br /> 2. DEPARTMENT OF PUBLIC WORKS (Staff Contact: Dean Gilman, 468-3000) <br /> a. All improvements shall be in conformance with the Improvement Standards and Specifications of <br /> the County of San Joaquin. All improvement plans and specifications shall include a grading plan <br /> for each individual lot, if applicable. These improvement plans and specifications are subject to <br /> plan check and field inspection fees and must be approved by Public Works prior to approval of <br /> the Final Map. If improvements referred to herein are not completed prior to approval of the Final Map, the <br /> subdivider shall execute an agreement with the County of San Joaquin to ensure the completion <br /> of improvements within one year after filing the Final Map. (Development Title Section 9- <br /> 1 10031Q) <br /> c. An Irrevocable Offer of Dedication to result in a 25-foot-wide right-of-way from the centerline of <br /> Bronzan Road to the property line shall be required across the frontage of the subdivision. The <br /> Irrevocable Offer of Dedication shall be made on the Final Map. <br /> d.
