) Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Use Permit Application No. PA-03-164 with the Findings and Conditions of Approval
contained in the staff report.
Findings
1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan,
any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan
adopted by the County.
• This finding can be made because the Group Care Facility-Farm Related use type may be
conditionally permitted in the AG40 (General Agriculture, 40-acre minimum) zone with an
approved Use Permit. The project is consistent with the goals, policies, and standards of
the General Plan, and there are no Master Plans, Specific Plans, or Special Purpose Plans
in the project vicinity.
2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary
facilities have been provided, and the proposed improvements are properly related to existing and
proposed roadways.
• This finding can be made because the Department of Public Works is requiring that the
applicant obtain an encroachment permit and improve the driveway along French Camp
Road in accordance with the requirements of San Joaquin County Standards CW-C11 or
CW-C12 prior to issuance of the occupancy permit. Standard Traffic Impact Mitigation
Fees will be collected prior to issuance of a building permit, and all new structures and/or
substantial improvements constructed on the parcel within the 100-year flood plain limits
shall be elevated a minimum of two (2) feet above the highest grade adjacent to the
structures. The applicants will also be required to obtain a Storm Water Pollution
Prevention Plan (SWPPP) permit from the State Water Resources Control Board prior to
the beginning of any construction. Storm drainage from each parcel will be retained on
the site with a retention basin. The Environmental Health Department(EHD) is requiring
that the project be served by a packaged sewer collection and treatment system
constructed in conformance with the requirements of EHD and the California Regional
Water Quality Control Board. The applicants will also be required to construct a water well
under permit and inspection of the EHD and obtain a yearly permit to operate a public
water system.
3. The site is physically suitable for the type of development and for the intensity of development.
• This finding can be made because the 40-acre parcel on which the construction will occur
is of adequate size to accommodate the proposed number of beds (84)for a group care
facility. All buildings will be required to comply with the setback requirements of the
Development Title for development in the AG-40 zone.
