�) Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit Application No. PA-03-164 with the Findings and Conditions of Approval <br /> contained in the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the Group Care Facility-Farm Related use type may be <br /> conditionally permitted in the AG40 (General Agriculture, 40-acre minimum) zone with an <br /> approved Use Permit. The project is consistent with the goals, policies, and standards of <br /> the General Plan, and there are no Master Plans, Specific Plans, or Special Purpose Plans <br /> in the project vicinity. <br /> 2. Adequate utilities, roadway improvements,sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because the Department of Public Works is requiring that the <br /> applicant obtain an encroachment permit and improve the driveway along French Camp <br /> Road in accordance with the requirements of San Joaquin County Standards CW-C11 or <br /> CW-C12 prior to issuance of the occupancy permit. Standard Traffic Impact Mitigation <br /> Fees will be collected prior to issuance of a building permit, and all new structures and/or <br /> substantial improvements constructed on the parcel within the 100-year flood plain limits <br /> shall be elevated a minimum of two (2) feet above the highest grade adjacent to the <br /> structures. The applicants will also be required to obtain a Storm Water Pollution <br /> Prevention Plan (SWPPP) permit from the State Water Resources Control Board prior to <br /> the beginning of any construction. Storm drainage from each parcel will be retained on <br /> the site with a retention basin. The Environmental Health Department(EHD) is requiring <br /> that the project be served by a packaged sewer collection and treatment system <br /> constructed in conformance with the requirements of EHD and the California Regional <br /> Water Quality Control Board. The applicants will also be required to construct a water well <br /> under permit and inspection of the EHD and obtain a yearly permit to operate a public <br /> water system. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the 40-acre parcel on which the construction will occur <br /> is of adequate size to accommodate the proposed number of beds (84)for a group care <br /> facility. All buildings will be required to comply with the setback requirements of the <br /> Development Title for development in the AG-40 zone.
