� r• <br /> Article 11 —Default and Landlord's Remedies <br /> Section 11.01. The occurrence of any one or more of the following events ("Events of <br /> Default") shall constitute a breach of this Lease by Tenant: <br /> (a) If Tenant shall fail to pay any rental or other sum required herein when due <br /> and shall fail to cure the same within five (5) business days following written <br /> demand by Landlord; or <br /> (b) If Tenant shall fail to perform any other term, covenant or condition to be <br /> performed by Tenant herein and Tenant fails to commence and thereafter <br /> diligently cure such default within thirty (30) days following written demand <br /> by Landlord; or <br /> (c) If Tenant shall make a general assignment for the benefit of creditors, or shall <br /> file a petition in bankruptcy. <br /> Section 11.02. If an Event of Default shall occur and Tenant shall fail to cure the same <br /> within the time constraints provided herein, Landlord at any time thereafter may exercise any <br /> and all rights and/or remedies as provided by law. <br /> Article 12—Attorney's Fees <br /> Section 12.01. In the event of any action or proceeding brought by either party against <br /> the other under this Lease, the prevailing party shall be entitled to recover its costs and attorneys <br /> fees in such action or proceeding in such amount as the court may adjudge reasonable. <br /> Article 13 —Notices <br /> Section 13.01. All notices and demands which may or are required to be given by either <br /> party to the other hereunder shall be in writing and shall be deemed to have been fully given if; <br /> (A) served personally. If such notice, demand or other communication is served personally, <br /> service shall be conclusively deemed made at the time of such personal service; (B) deposited in <br /> the United States mail, certified or registered, postage prepaid, and addressed to the party at the <br /> address specified on the signature page of this Lease. If such notice, demand or other <br /> communication be given by certified or registered mail, such notice shall be deemed given three <br /> (3) days after the deposit thereof in the United States mail; or (C) delivered by guaranteed <br /> overnight delivery service, delivery charges prepaid and addressed to the party at the address <br /> specified on the signature page of this Lease. If delivered by overnight delivery service, such <br /> notice shall be deemed to be given one (1) business day after being given to the overnight <br /> delivery service. <br /> f <br /> 1 <br /> I <br />
