Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit Application No. PA-1000217 with the Findings and Conditions of Approval <br /> contained in the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This Finding can be made because the Religious Assembly-Regional use type may be <br /> conditionally permitted in the AG-40 (General Agriculture,40-acre minimum) zone with an <br /> approved Use Permit application. The project site has a General Plan designation of AIG <br /> (General Agriculture). The AG-40 zone is an implementing zone of the General Agriculture <br /> designation of the General Plan. The proposed Religious Assembly presents no <br /> significant General Plan policy issues; there are no Master Plan, Specific Plan, or Special <br /> Purpose Plans applicable for this site. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> This Finding can be made because the project will be required to be served by an on-site <br /> well, septic system, and on-site retention basin. The Environmental Health Department is <br /> also requiring an addendum to the soil suitability/nitrate loading study dated June 4, 1999, <br /> incorporating the proposed expansion of the existing religious assembly facility indicating <br /> that the area is suitable for septic system usage. The sewage disposal system shall <br /> comply with the on site sewage standards of San Joaquin County prior to approval. The <br /> construction of an individual sewage disposal system under permit and inspection by the <br /> Environmental Health Department is required at the time of development. The Department <br /> of Public Works required a traffic study which was prepared on July 25,2011, by TJKM. <br /> Mitigation measures include providing an on site overflow parking lot, constructing east <br /> and west bound turn lanes, and signage and striping to allow only right in and right out <br /> access to the project. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> This Finding can be made because the 20 acre parcel is of adequate size and shape to <br /> accommodate the proposed use, building coverage, setbacks, and other requirements of <br /> the Development Title. The Site Plan shows that there is sufficient area for parking and <br /> circulation, in compliance with Standards of the Development Title.
