A public CEQA scoping meeting was held for this Draft EIR on September 24,2003 at the Lammersville School <br /> ` District Multipurpose Room, 16555 West Von Sosten Road,Tracy,California.The meeting provided responsible <br /> agencies,trustee agencies,and members of the public the opportunity to comment on the proposed scope of the <br /> Draft EIR. The public continents received on the NOP are included in their entirety as Appendix E of this Draft <br /> EIR. In addition,multiple community workshops were held in 2003 and 2004 to present the project proposal to <br /> the community and to seek public input. <br /> DRAFT EIR <br /> This Draft EIR will be distributed to responsible agencies,trustee agencies, and members of the public(property <br /> owners on-site and within 1,400 feet of the project site)for 45-days as required by CEQA,commencing on March <br /> 14, 2005.This Draft EIR will also be made available for public review during the review period at the SJCCDD <br /> and area libraries,and on the County's website. <br /> FINAL EIR <br /> Following receipt of comments from the responsible agencies,trustee agencies, and the public on this Draft EIR, <br /> written responses will be prepared and incorporated with the comments into the Final EIR, along with a list of any <br /> corrections and additions to this Draft EIR that may be required in response to agency and public comments. <br /> PROJECT HEARINGS/APPROVALS <br /> The Final EIR will be considered separately by the San Joaquin County Planning Commission and subsequent to <br /> r that hearing,by the San Joaquin Board of Supervisors(Board).Each plan to conduct hearing(s)will provide <br /> public agencies and the public with an opportunity to make verbal comments. If the Board finds that the Final EIR <br /> adequately addresses the environmental impacts of the project, it will certify the Final EIR and take action on the <br /> project(i.e.,approve the project, approve the project with revisions,reject the project, or continue the hearing to a <br /> later date). <br /> Approval of the project,as proposed or revised,must be accompanied by written findings for each significant <br /> adverse environmental effect identified in the Final EIR.The findings will include a brief explanation of the <br /> reason for each finding and will indicate that: (1)mitigation measures to reduce adverse impacts to less-than- <br /> significant levels have been adopted; (2)mitigation measures to reduce adverse impacts to less-than-significant <br /> levels are within the jurisdiction of another public agency and either have been or should be adopted by that <br /> public agency; or(3) specific significant impacts are unavoidable and/or cannot be reduced to less-than- <br /> significant levels through feasible mitigation. <br /> ~ If significant unavoidable adverse impacts are identified in the Final EIR and the findings,and the Board decides <br /> to approve the project in light of these impacts,the Board must adopt a Statement of Overriding Considerations as <br /> required under Section 15093 of the CEQA Guidelines.The statement will explain why the Board is approving <br /> the project in light of the project's significant unavoidable impacts,as permitted by Section 15093, which states <br /> that"If the specific economic,legal, social,technological,or other benefits of a proposed project outweigh the <br /> unavoidable adverse environmental effects,the adverse environmental effects may be considered acceptable." <br /> If the Board approves the project,it must also adopt a MMP for the project,as required by CEQA.The MMP will <br /> list the mitigation measures adopted by the Board,the timing of required implementation of each mitigation <br /> measure,and the party responsible for implementing the mitigation measure.The MMP will be used by County <br /> staff to ensure that the mitigation measures are implemented when required and to track the progress of <br /> implementation. <br /> College Park at Mountain House Specific Plan III Draft EIR EDAW <br /> San Joaquin County 1-5 Introduction <br />
